س: لقد مر أكثر من عام منذ أن دفعت كامل المبلغ مقابل شراء عقار جاهز للسكن. لم يحدد المطور العقاري موعدًا لإصدار سند الملكية لي.
لقد قدمت شكوى إلى دائرة الأراضي والأملاك بدبي. ومع ذلك، أخبروني أنه تم فرض غرامة على المطور العقاري والآن يتعين عليّ إحالة الأمر إلى المحكمة.
لديّ كافة المستندات المطلوبة للتحقق مما ورد أعلاه.
أريد أن أعرف ما يلي:
1) هل يمكنني مقاضاة المطور العقاري ومطالبته بالتعويض عن التأخير في إصدار سند الملكية؟
2) هل يحق للمطور العقاري تحصيل رسوم الخدمة مني في حالة عدم إصدار سند الملكية؟
3) كم (تقريبًا) سيكلفني إحالة الأمر إلى المحكمة؟ هل من الممكن تسوية الأمر خارج المحكمة؟

مطالبة المطور العقاري برسوم تسجيل العقار
س: تم توقيع العقد في يناير 2017. تبلغ رسوم دائرة الأراضي والأملاك بدبي 4% من قيمة العقار. حيث يدفع المشتري 2٪، ويدفع البائع 2٪، ولكن البائع زور الفاتورة حتى أدفع 4٪.
يجب أن أسترد المبلغ الإضافي المدفوع بنسبة 2%.
تم دفع:
السعر الأساسي 565,000 درهم
رسوم التسجيل في دائرة الأراضي والأملاك بدبي 22,600 (4٪ من قيمة الفاتورة)

السعر الصافي 587,600 درهم
فاتورة 2019 للحصول على سند ملكية: 76,819 درهم.
فاتورة جديدة في يناير 2020 للحصول على سند الملكية.

رسوم تسليم سند الملكية: 210,00 درهم.

س: مرحبًا،
لقد اشتريت شقة تحت الإنشاء في إمارة دبي العام الماضي. لقد دفعت الوديعة ورسوم التسجيل في "عقود" ودفعت جميع الأقساط في الموعد المحدد لحساب الضمان الخاص بالمطور العقاري.
ومع ذلك، لقد قام المطور العقاري بتأجيل إصدار اتفاقية البيع والشراء واتفاقية عقود حتى الآن بدون سبب وجيه، على الرغم من أنهم جعلوني أوقع اتفاقية البيع والشراء من جانبي وأخبروني أنهم سيوقعون عليها بعدي وسيقومون بتوثيقها في دائرة الأراضي والأملاك بدبي.

A bank has filed an execution cheques case through the Dubai Courts due to nonpayment of a personal loan and credit card.
Is a travel ban automatically applied?
I looked on the Dubai Courts website, and it says the judge has issued a “reserved” order for my case.
Furthermore, when the bank emails, they threaten me with a travel ban. So I am assuming there is no travel ban issued (but I don’t know). I haven’t received any notice of a travel ban.
If there is a travel ban, how do I find out?
I have checked the Dubai police app, and there are no financial crimes against me.
Please advise if you know.

I am writing to seek your legal expertise and advice on a pressing issue concerning a property sale transaction that my brokerage company has facilitated.
Here are the details:
Our brokerage company represented the seller in a property sale where the property was sold with an existing rental agreement in place.
As per the terms of the agreement, the rental balance was supposed to be given to the buyer, who is now the new owner of the property.
In this transaction, our company is entitled to a 40% commission, and the buyer's brokerage company is entitled to 60%.
However, the buyer's brokerage company, which has complete control over the buyer's funds, has transferred the entire 100% commission to their own account.
They are currently withholding this commission, stating that they will release it once the rental balance is paid to the buyer.
Unfortunately, we have lost contact with the buyer, as he has blocked the seller's agent, making it impossible for us to fulfill this condition.
