س: لدينا مستأجرة، وقد نص عقد الإيجار بوضوح على ضرورة تسليم العقار على نفس الحالة التي تسلمه عليها. ستغادر الآن المستأجرة الشقة الكائنة في منطقة نخلة جميرة (2 بي آر). تخيل هناك 16 مصباح مكسور مع وجود كسر في حاجز وقاية الثلاجة وكذلك العديد من الخدوش إضافة إلى اتساخ الشقة. لقد تسلمت الشقة مطلية ونظيفة، وهي الآن تقول أنها ستقدم بلاغ في هيئة التنظيم العقاري لأنها غير مسؤولة عن أعمال الطلاء والتنظيف (وترغب في استرداد أموالها) ولن تقم باستبدال المصابيح التالفة وحاجز وقاية الثلاجة. عندما سلمنا العقار، أعطيناها 14 يومًا مهلة وقمنا بحل جميع المشكلات. هل يحق لها كل هذه المطالبات التي تخبرنا بها؟ نحن لم نرد إليها مبلغ التأمين بعد حتى تقوم بإصلاح العقار. هل يحق لنا قانونًا المطالبة بهذا المبلغ؟ أعرف أن المصابيح سلع مستهلكة  ويجب عليها أن تستبدلها، حيث أن كافة المصابيح كانت تعمل حين استلمت العقار. شكرًا لك.

Q: Hi, A security deposit of AED 3,500 was paid to the landlord when I moved in and rental payment for each month was monthly. I moved out for personal reasons 4.5 months later and all rental payments were made for my time there. At the time of viewing the room, it is being claimed that the landlord stated the minimum term was 6 months, which was never put in writing or was it ever confirmed I would lose my deposit even when I gave my 30 days notice. There is no contract or correspondence to confirm any of this. The landlord lives in the property and is refusing to return any of my deposit. She is ignoring me now by blocking my number. I even offered her just over AED1,000 as a pro rata settlement as a goodwill gesture, but that is when she blocked me after she read it. I refused her 50/50 offer. If filing a complaint can cost AED 2.5k-3k where do I stand it seems like a pointless exercise, I don't think RERA will look at it? Do I go to the police? I'd prefer to avoid this option. Thanks

Q: Dear Sir or Madam, Good Afternoon. Two months ago, we have moved from an apartment, settled all the bills, and collected our security deposit back from the agency. However, the agency is sending us an email saying that the cooker is not working at all at the moment, and that was caused by us. During our stay, we did have an issue with the cooker, smoked started coming out, and at that time we informed the building management as they had to shutdown the power. The oven was fixed afterwards by the building management and was working properly. We didn't pay for anything. Please advise, can agency press charges against us, or do we need to pay for the new cooker, as that is what they are asking from us now? Appreciate your assistance with the matter, Thank you!

Q: Dear Sir/Madam, I left the flat with 2 months' prior notice and gave a DEWA clearance certificate to the building management. Now they are claiming compensation for a damaged door, amounting to AED 9000, and they have my deposit of AED 2000. They are asking me to settle the amount of AED 9000, otherwise they will take legal action against me. Am I bound to pay the extra amount? I have already left Dubai for India. Please advise me on what to do.

تخضع العلاقة بين المستأجرين ومالكي العقارات في دبي للقانون رقم 33 لعام 2008 بشأن العلاقة بين مالكي ومستأجري العقارات في إمارة دبي. تتم إحالة منازعات الإيجار الناتجة إلى مركز فض المنازعات الإيجارية ("RDSC") الذي تم إنشاؤه بموجب المرسوم رقم 26 لعام 2013 للتوفيق بين الأطراف والوصول إلى حل ودي أو طلب إصدار حكم نهائي وإنفاذه من خلال مركز فض المنازعات الإيجارية.

The provisions of this Law apply to real property leased out in the Emirate of Dubai, including vacant and agricultural lands, but excluding hotel establishments and real property provided by natural or legal persons as accommodation to their employees at no charge.

Provisions of this Law supersede articles (2), (3), (4), (9), (13), (14), (15), (25), (26), (29), and (36) of Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai. 

This Decree establishes a specialised judicial system to hear rent disputes and develops the procedure for determination of such disputes through an expeditious and simple process for the purpose of realising social and economic stability for all persons involved with the real property rental and other related sectors.
