Is it possible to pay a fine instead of serving 1 month imprisonment and still face deportation?

Hello,

I got 1 month imprisonment, a 100 AED fine, and deportation.

Is there a way out if I can pay instead of serving 1 month imprisonment and still get deported?

Yes. In this case, we submit a request to the public prosecution to exchange the punishment and mention our reasons. Finally, the approval depends on the reasons and is up to the prosecutor.

Thanks!

Hello,

If you believe the decision is unjust or you have new evidence, you may be able to appeal the case to a higher court.

This can sometimes lead to a reduction in the sentence or fine, and potentially even the reversal of deportation.

The appeal must be filed within a specific time from the initial judgment (usually 30 days).

Hello,

If you are still within the appeal period, we can file the appeal in order to remove the deportation order.

We will let you know the procedures in detail.

Kindly share your WhatsApp number to discuss further.

Dear Client,

In the UAE, for some misdemeanors, courts can order deportation as an alternative to imprisonment, meaning you may be deported instead of serving jail time.

However, if your judgment specifically states both 1 month imprisonment and deportation, the default is to serve the jail term first, then be deported.

Is it possible to pay a fine instead of jail?

For minor offenses, courts sometimes allow a fine to replace short jail terms, but this depends on the judge’s decision and the nature of the offense.

If your judgment does not mention this option, it is not automatic. You or your lawyer would need to formally request the court to convert the jail term to a fine.

What can you do?

- File an appeal or request: You have a short window (usually 15 days) to appeal or request the court to replace jail with a fine, but approval is at the court’s discretion.

- Deportation: Even if you pay a fine or serve jail time, deportation will still be enforced unless you successfully apply for its suspension or cancellation, which is rare and only granted in exceptional cases.

Summary:

You cannot automatically pay to avoid jail if your sentence includes both imprisonment and deportation. You must apply to the court to request a fine in place of jail, but approval is not guaranteed.

Deportation will still apply unless separately lifted by the authorities. Consult a UAE criminal lawyer immediately to explore your options.

Dear Questioner,

Thank you for reaching out!

We understand that you have been sentenced in the UAE to one month of imprisonment, a fine of AED 100, and deportation.

In many cases, it is possible to explore alternatives to imprisonment, such as paying a compensation amount in lieu of serving the jail term, depending on the nature of the offense and the discretion of the court.

Our legal team can assist you with the following process:

- Case Review: Our company’s lawyer will first review the court judgment and case file to understand the nature of the offense and whether it qualifies for conversion of the jail term into a fine.

- Petition for Sentence Conversion: If applicable, we will file a request with the court to convert the one-month imprisonment to a financial penalty (usually calculated per day of jail time). This is at the court’s discretion and not guaranteed.

- Deportation Appeal: Deportation in the UAE is mandatory in certain criminal cases, especially those involving moral turpitude or immigration violations. However, we can evaluate whether there is any scope to request cancellation or suspension of the deportation order, based on the specifics of your case.

- Follow-Up and Representation: Our legal team will handle all court appearances, documentation, and liaison with authorities on your behalf.

Please share a copy of your court judgment and any other relevant documents at your earliest convenience, so we can begin the process. We will provide a full legal opinion after review and outline the exact steps, timelines, and potential outcomes.

Best regards,

Mohammad Salah

Greetings,

If a court has issued a final judgment of 1-month imprisonment, AED 100 fine, and deportation, it may still be possible, depending on the case type and court level, to explore alternatives such as paying a fine in lieu of imprisonment or filing an appeal or pardon request.

However, deportation orders are typically mandatory for certain offenses and may require legal intervention to challenge or postpone.

To assess your specific legal options, we recommend you book a consultation or authorize us to act on your behalf.

According to UAE law, it is possible to negotiate a reduction of the sentence or have it converted to a fine, but this depends on the court’s decision.

Our legal center specializes in these cases and can provide legal support via WhatsApp for further assistance.
