Q: Hi. I have been promoted from Coordinator role to Manager role in February 2017. In these months I have never received any complaint from my manager regarding my performance, no any written notice or warning. A month ago, my manager said that she thinks I have some communication problem, and I cannot work under stress. For that reason, my manager wants to demote me and cut my salary. It has been said in the email without any clarification. Next day, she called me for a meeting to offer me Support position and said that my salary will be decreased by 35%. I agreed verbally, as I have been scared to lose the job if I do not take this offer. There hasn't been any notification in writing provided to me. Now, I have to renew my visa as my company will cancel my old visa to apply for a new one, and I will be requested to sign the letter with the demotion. I don't want to do this, as I think it is illegal. May you please advise what will happen if I refuse to sign that paper and if they will terminate me because of it. Thanks. Tatiana.

س: سيدي، أعمل بمطعم كمراقب جودة. قبل ذلك، كنت أعمل بمطعم في دبي وكان راتبي 5000 درهم. طلب مني مدير إداري بمطعم بأبو ظبي الانضمام إلى مطعمه، وعرض علي راتب يبلغ 7000 درهم. لذا قدمت استقالتي بمطعم دبي. وبعد الالتحاق بمطعم أبو ظبي، وجدت أن عقد العمل ينص على أن الراتب 4500 درهم فقط. فقال المدير الإداري أنه لكي أحصل على 5000 درهم لابد من دفع مبلغ تأميني أكبر، وأنه سيدفع الباقي نقدًا أو بشيكات. وهكذا وقعت العقد. لكن المطعم لم يدفع لي الراتب، فقد عملت لحوالي 11 شهرًا، لكنه دفع لي 6 أشهر فقط. وفي تلك الأشهر الستة، كان المدير يدفع لي الراتب الأساسي فقط (الراتب المذكور في عقد العمل: الراتب الأساسي 3500 درهم، و1000 درهم بدل، بواقع 4500 درهم).والآن يقول المدير أنه لن يدفع لي شيئًا لأنني تسببت في خسائر للمطعم. برجاء مساعدتي في هذا الموقف.

Q: Hi, and good day to you. I just want to ask what is the status of my contract here in Dubai. Actually, I have an employment contract and it needs to be revised because as per the Philippines labour law, my salary is below the minimum which is only AED 1100 basic salary. That's why my employer proceeded to MOL for the approval of changes. How long does it take to complete the process? I hope you will give time to my inquiry. Thank you

Q: Dear Sir/ Madam, In my offer letter, the designation is Accounts Manager; however, since I have not attested degree certificates the employer promised to give me Archive Clerk Visa. They took my thumb impression and signature on blank paper and later they issued me a Messenger Profession Visa. When I inquired about the same and refused to accept the Messenger Visa, they are blaming me that I agreed to this Messenger Visa and asked me to pay the visa costs and leave. I sent the resignation and agreed to pay the visa cost, but the visa cost is double what they have quoted. Note: the visa is not stamped on my passport. Will I get any ban from MOL, if the visa is cancelled? Kindly advise... Thanks in advance

س: السيدة / خان، مرحبًا، لقد استلمت مؤخرًا عرض عمل، ولدي سؤالين بشأنه. 1. المسمى الوظيفي المنصوص عليه في عرض العمل هو "مهندس"، بينما المسمى الوظيفي في عقد عمل وزارة العمل هو "مندوب مبيعات". بعد التواصل مع قسم الموارد البشرية في الشركة للتوضيح، أخبروني أنهم أصدروا التأشيرة بمهنة " مندوب مبيعات" بسبب التوطين "الأمرتة" ولإصدار التأشيرة بصورة أسرع، ثم بعد مرور ستة أشهر أو سنة فيمكن أن أتواصل معهم ويتم تغيير المسمى الوظيفي المنصوص عليه في عقد العمل الخاص بوزارة العمل. سؤالي هنا هو هل يمكن أن يتم تعديل الوصف الوظيفي المنصوص عليه في عقد العمل في المستقبل، وما مدى سهولة أو صعوبة عمل ذلك؟ ما هي العيوب (إذا وجدت) والتي من الممكن أن أواجهها إذا حصلت على تأشيرة بمهنة "مندوب مبيعات"؟ 2. لقد قم بالتوقيع على عقد العمل الصادر من وزارة العمل وأرسلته إلى الشركة، لقد مرت سبعة أيام ولا أزال أنتظر الموافقة على تصريح العمل. أليس هذا بطيء بعض الشي بالنسبة للحصول على موافة تصريح العمل؟ عقدي هو عقد محدد المدة. شكرًا لكِ.

Q: My employer hires new staff with a higher salary than the old staff who have the same work. I just want to ask if that is fair for the old staff?

س: إذا تلقينا خطاب عرض العمل  براتب إجمالي 6000 والراتب الأساسي هو 2000 على سبيل المثال، فهل لنا الحق في أن نطلب من صاحب العمل زيادة الراتب الأساسي؟ ماذا لو رفض طلبنا؟

Q: I had signed an unlimited contract with a Dubai based company. In the offer letter, I was given a designation as Business Manager with salary AED 30,000/month. However, in the MOHRE contract, my designation is showing Sales Executive having 4th/5th level skill. When I inquired from them, they told me that the designation in MOHRE contract will not have any adverse effect during my stay in Dubai and they have mentioned 4th/5th level skill in the contract because my certificates ( B Tech ) are not HRD attested ( in India ) and they will not be able to wait for long for this attestation. My questions are:- a) Is this procedure legal i.e. getting a person of Engineering degree in 4th/5th level skill set? b) Will it be possible to change the skill level in MOHRE contract if I get my degree attested by HRD and UAE consulate after I land in Dubai? c) What are the possible issues that I will face?

س: سيدي العزيز، ستقدم لي الشركة التي أعمل بها تدريبًا باهظ التكلفة. ولكنهم يريدون مني توقيع مستند يفيد بأنه بعد إنتهاء التدريب، سأكون مُلزمًا بالعمل لدى الشركة لمدة ثلاث سنوات. أريد أن أعرف في حالة أنني تلقيت هذا التدريب ثم ذهبت في المستقبل القريب إلى أحد دول الخليج الأخرى، هل سيتم فرض حظر علي في هذا البلد أو سأتعرض لأي عواقب أخرى؟ يرجى تقديم المشورة.

س: أنا خريج جديد متدرب بدوام كامل لدى شركة تعمل في مجال النقل لأكثر من عام بينما كنت استكمل دراستي. ولقد تخرجت في شهر مايو. في شهر مارس من هذا العام، عرضت عليّ الشركة عقد عمل بدوام كامل حيث أنني الآن على وشك الانتهاء من دراستي. واستمروا في إعطائي بدل التدريب (1000 درهم إماراتي) حتى تقديم كافة المستندات لمعالجة التأشيرة. لقد قدمت كافة المستندات الخاصة بي لمعالجة التأشيرة في نهاية شهر مايو. كما انتهت فترة السماح الممنوحة لي بعد الإلغاء في 25 يونيو. ولكنهم ما زالوا يدفعون لي بدل التدريب. الآن بعد أن أصبحت التأشيرة معلقة من جانبهم، ألا يجب عليهم أن يدفعوا لي الراتب بالكامل؟  أعتقد أيضًا أنه كان ينبغي عليهم دفع الراتب بالكامل بمجرد توقيع العقد بغض النظر عن حالة التأشيرة لأنني كنت أعمل لديهم بالفعل. يرجى إخباري بشأن ما إذا كان يجب عليّ مطالبة الشركة بدفع الراتب بالكامل منذ وقت توقيع العقد (شهر مارس) أم بدايةً من هذا الشهر فحسب (التأشيرة معلقة من جانبهم)؟

Q: Dear Sir/Madam, I have been working for a recruitment agency and I was told that my hourly rate would go up after 12 weeks. I was also given a handout that said this. However, they are now telling me that to get the higher rate, I have to have been in the same placement for 12 weeks. I wasn't told this and it's not on the handout.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
