Unpaid for 5 months: Should I leave immediately or file a complaint with MOHRE?

Q: Good day! I would like to seek advice regarding my situation. I am currently employed by a Freezone company under a limited contract valid until October 2024. The issue is that they haven’t paid our salaries for 5 months (since February 2024). We have been receiving monthly promises that they will pay and settle the amounts, but we haven`t received anything. I tried talking to the management and sent them emails, and they again promised that they will settle everything in 2 months. I want to know my rights and if it is possible to leave without the notice period since they are already in breach of contract. Additionally, is it better to complain to MOHRE immediately before my resignation, or should I wait for the 2 months they promised? Thank you for the insights!

Q: Dear Lawyers, I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August. Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F. The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer`s real estate commission and the conveyancing fee. Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this? Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?

Article 322 of UAE Civil Procedure law states as follows: "If the debtor is a private legal entity, the order shall be issued for the imprisonment of who represents the company legally or any other person if the refusal from execution is attributed to them personally." Does "the refusal from execution is attributed to them personally" apply only to "any other person" or also applies to "who represents the company legally"? If I ask for the detention of the manager or partner of a company, have I to prove that the manager/partner is refusing to execute the writ?
