س: اشترينا قطعة أرض سكنية في إمارة الشارقة. وسُجِّلت باسم شريكين مواطنين. الشريك الأول يمتلك ٣٣٪؜، والشريك الثاني يمتلك ٦٧٪؜ من الأرض على أساس الشريك الثالث أجنبي سيأخذ نصف نسبة الشريك الثاني عن طريق المبايعة. هل تتأثر حقوق الشريك الأول بصغر نسبته؟ وهل يحق للشريك الأول بيع الأرض؟ هل يجوز البناء على قطعة الأرض بدون معرفة حد الشراء؟ ما المبايعة للأراضي وما الحقوق المترتبة عليها وعلى صاحب المبايعة؟

Termination of a property SPA due to COVID-19 situation

Q: I have made a 20% down-payment against an off-plan property in 2017. The sale & purchase agreement does not include a "Termination/Refund" clause and the property is due for handover by the end of the month. The property value has dropped by 40% and I`m able to only get a mortgage for 80% of the current value. However, due to the current situation and the impact of COVID-19 financially, I`m not in a position to proceed with the remaining instalments. I have to forfeit the contract as the developer has not given me any options for deferral of payment and has declined the request for a delayed handover. Please advise if and how I can get a refund on the 20% amount that has already been paid upfront.

Q: I had invested in a project in Dubai in Oct 2018, in a 3 bedroom townhouse. I have paid them 24% of the house amount till now but haven`t received anything except for SPA and receipts from them. No registration of the property has also been done wherein we were supposed to get the house in Dec 2019 the handover. On checking, we got to know that they haven`t even got permission from the land department for that particular row of townhouses in which we had booked our unit, and no construction has also happened till now. They offered us another unit instead to take which they claim will get finished in Dec 2020. But because they have been lying to us since the beginning and have taken money from us without any permission being in place, we want to exit from the agreement and get our money refunded.
