س: السلام عليكم ورحمة الله وبركاته جددت عقدي وأنا معلم مدرسة. تاريخ عقدي الجديد 1/8/2020 وينتهي في 31/7/2021. لا أريد أن أجدد العقد، هل يترتب علي حقوق؟ وهل أستطيع الحصول على مستحقاتي؟

The rights of a foreign investor when the unit is not delivered on time

Q: I bought a studio. According to the SPA, the unit must have been handed in December 2019. As I understand, developers in the UAE have 1 year grace period so, technically speaking, the project must be completed in December 2020. However, according to the project tracking website, the likely completion date is Q1 2021. When I enquired about this, they are reluctant to comment on it. As a foreign investor, what are my rights in this situation? The project is only 47% complete thus far. Thanks!

مدى صحة العقد العرفي في التنازل عن رخصة تجارية

س: تم توقيع عقد عرفي بتنازل عن رخصة تجارية حيث أن المتنازل إليه يقوم بتحمل كافة الاستحقاقات المرتبطة للرخصة وتم اعتماد التنازل الأصلي لدى كاتب العدل. وفي نفس الوقت، تم توقيع العقد العرفي، إلا أن الكاتب العدل رفض توثيقه وتم توقيعه بدون شهود. فهل يعتد بهذا العقد؟ الشيكات الموقعة قبل التنازل من يتحملها وحتى الحساب البنكي والتزامات البنك مع العلم أنه مذكور بالعقد العرفي؟ ولكم جزيل الشكر

عدم التزام المستأجر إرسال إخطار بفسخ عقد الإيجار قبل نهايته

س: السلام عليكم موجود بند بالعقد إذا أراد المستأجر عدم تجديد العقد أن يخبر المؤجر كتابياً قبل نهاية العقد بشهر، إذا أراد تجديد العقد أم لا. وهذا لم يحدث حيث أخبرنا بعد نهاية العقد السنوي ب 24 يوماً، علماً بأن العقد سنوي يدفع مقدم سنوي.

Validity of the employment contract if based outside the UAE

Q: Hi, I was employed by a DMCC business but was based overseas (in Australia), not working in the UAE. My employment contract was not registered with DMCC or MOHRE and I am looking to confirm what specific law requires UAE businesses to register employee contracts. Is this requirement applicable to workers based overseas? I`m in dispute with my employer and have been advised that my employment contract is not valid due to it not being registered. Many thanks.

Q: Dear ATA Consultancy, I bought 2 apartments in Istanbul, the first one in 10/2018 (TL 450,000) through payments and finished last payment in 1/2020 (but still didn`t receive the title deed - Tabu - yet), and the second apartment in 03/2019 (TL 425,000) through payments and received the tabu on 30 December 2019. Payments were made by transferring from my Jordan bank to my Turkish bank and paying to the real estate developer from my Turkish bank.
