Renewing a rental agreement while it is agreed not to get renewed

Q: Hi, I have a question regarding a rental agreement. We are the landlord and one of our properties is rented. So before the contract was signed, we agreed with the tenant and put it in writing that this would be the last year of rent, and there would be no renewal once rent expires. This condition is in the contract. The tenant agreed and signed. Now the tenant doesn`t want to follow the agreement and is forcing us to renew for another year. What can we do about it?

Q: Hello. I am facing a really horrible time after visiting one of the salons in Dubai in December 2020. I had permanent makeup remover on my eyebrows and it is been now 1 year and a half and I have horrible red scars on my face instead of eyebrows. I visited a lot of clinics trying to improve it, however, all doctors are saying it is scars and nothing can be done and I have to live with it. I want to file a case against that salon that did it for me. I am a young lady and now I have to hide my face once I step out of my apartment because of these horrible scars. My lifestyle is changed, I am trying to avoid people so they will not look at my scars, it kills me day by day and I got so much depressed.

س: السلام عليكم، لدي بيت مؤجر لشركة عقارية. وبحكم أني أعيش خارج الإمارات، تعرضت لنوع من النصب حيث لم يتم إخباري عن موضوع الإخطار القانوني لإخلاء البيت. بعد درايتي بالموضوع أرسلت إخطارًا قانونيًا في شهر سبتمبر الماضي لإخلاء البيت، مع العلم أن عقد الإيجار حُرر في فبراير 2021 والإخطار القانوني في سبتمبر 2022 لأني أنوي الاستقرار في بيتي بالإمارات مع عائلتي إن شاء الله. أريد من فضلكم معرفة هل يحق للشركة العقارية تمديد مدة الإيجار رغم الإخطار القانوني؟ صاحبة الشركة لا تريد التواصل معي حتى مستحقاتي (الإيجارات) لم أتوصل لها وبيتي معروض للإيجار على الإنترنت بعقد سنوي. مع العلم حسب القانون، لا بد من تسليم المفاتيح في شهر سبتمبر. وشكرًا!

س: السلام عليكم، أنا مستأجر شقة في إمارة دبي واستلمت إيميل بتوقيع المالك قبل 90 يومًا من انتهاء العقد برغبة المالك في عدم التجديد. استلمت على الواتساب رسائل من المالك تسأل هل استلمت الاخطار. في ذلك الوقت كنت على علم أن مكان عملي سوف يتغير فلم أمانع الإخلاء ولم أقبله. بعد شهر، أرسل لي المالك إخطارًا جاهزًا للتوقيع مفاده أني طلبت عدم تجديد العقد. رفضت التوقيع ووضحت له أنني على استعداد لتجديد العقد وحاولت التواصل مع المالك لكن لم يستلم أي مكالمة من طرفي وتواصلت معه على الواتس بعدها بشهر ووضحت رغبتي في تجديد العقد. أجاب أنه لا يريد تجديد الإيجار وأننا على اتفاق علي عدم التجديد بالرغم من أنني لم اتفق على ذلك ولم أطلب عدم التجديد ولم أخبره بذلك. ما الوضع القانوني في هذه الحالة؟

Q: I would like to ask whether it is safe for me to visit the UAE again or not. I visited Dubai with 90 days visa last time. When I hung out with my friends, policemen came to us to check our IDs. I showed my passport because I was just a visitor and my local friends showed them their Emirates IDs. Some of my friends who have an Emirates ID received a fine notice of violation of Covid-19 regulations by SMS the next day from the Dubai police which I didn`t. This happened about 1.5 months before my departure. I called Dubai police after the incident and the officer told me that it should have been ok if I hadn`t received a fine paper ticket that day without checking my passport number. When I went to Dubai airport, no one stopped me at customs and I left the country. I am worried if there is a possibility I might get arrested on arrival when I visit the UAE next time. Your legal advice is much appreciated.

The rights of the tenant and the landlord in case of early exit from tenancy

Q: Hello Sir! I rented an apartment in a villa in Abu Dhabi 4 months back and paid 4 months` rent in cash and have given three cheques for the remaining rent in advance (4-4 months) one cheque is a security cheque. We signed a contract for one year. Now because I got terminated from the job, I informed the landlord with one month`s notice and evicted the house after 3 months leaving one month`s of rent to him as discussed at the time of the contract. I lived only for 3 months. Now the landlord is not returning my cheques and demanding all the amount of the remaining year and threatening me for filing a case if he bounces my cheque. I negotiated and he asked me now in the last conversation to pay only for 3 months more and he will give me back my cheques, What should I do? I can`t pay even for the 3 months since I have evicted the house as discussed. What are my legal rights in such a case and what`s the worse I can expect if he bounces my cheques? Kindly advise.
