العميل سدد المبالغ التي استخدمها ورفض دفع مبالغ الفائدة البنكية. هل يجوز ذلك؟

س: السلام عليكم، هل يحق للبنك في إمارة دبي أن يرفع دعوى جنائية أو مدنية ضد عميل لم يسدد مبالغ الفائدة بل سدد فقط المبالغ التي قدمها البنك أصليًا (مبلغ القرض فقط)؟ منحه البنك بطاقة ائتمانية بحجة أنه "قرض حسن بدون فوائد"، وبعدما استخدم العميل البطاقة الائتمانية بفترة زمنية قصيرة وفجأةً تم إرسال رسالة إلى العميل تفيد بأن هناك مبالغ متراكمة بسبب الفائدة البنكية بقيمة ٤٠٪؜ من القرض الأساس المُقدم إليه. علمًا بأنه تم تزويد العميل بالبطاقة الائتمانية عن طريق البريد السريع لعنوان منزله بدون طلب رسمي من العميل بذلك، بالإضافة إلى أنه لا يوجد أي من المستندات التالية بين البنك والعميل: ١- عقد. ٢- اتفاقية. ٣- شيكات كضمان. ٤- سند أو شريعة أو قبول خطي أو غير خطي أو توثيق يتضمن أي توقيع من الأطراف؛ بمعنى آخر، لا يوجد أي اتفاق على الإطلاق. العميل سدد المبالغ التي استخدمها ورفض دفع مبالغ الفائدة البنكية المضافة سالفة الذكر. الرجاء الإفادة ولكم جزيل الشكر!

Removing a travel ban after paying the fine for a misdemeanor case

Q: Hello people, Once I pay the fine to the court for a misdemeanor case, can I ask the court to remove the travel ban imposed on me? And could it be removed almost immediately? Please explain! I’m not so aware of the UAE’s penal code. Many thanks!

استئناف حكم عمالي بمثابة الحضوري بزعم عدم استلام الحكم الابتدائي

س: السلام عليكم، لدي قضية عمالية حُكم فيها بمثابة الحضوري في 13/04/2022، ومن ثَم أعلنت الخصم بموجب طلب قدمته للمحكمة، وبعد الإعلان تم عمل صيغة تنفيذية والإعلان للمرة الثانية بالتنفيذ في 03/08/2022. تقدّم الخصم بتسجيل دعوى استئناف على الحكم الابتدائي بزعم عدم استلام الحكم الابتدائي بالرغم من أن الإعلان كان بنفس طريقة إعلانه بالصيغة التنفيذية. رجاء الإفادة عن مدى قانونية دعوى الاستئناف!

Q: Dear sir/madam, I was a partner in a license in DMCC. But now I have completely given it to the other partner. He hasn`t renewed his license and my visa is already expired more than a year. I need to cancel this visa and take another visa for my own company in Mainland/Ajman. I have been trying to do it through DMCC but it is taking a long time. س: السلام عليكم، استلمت ثلاثة شيكات بقيمة ٢١٢ ألف درهم من شركة ذات شخص واحد في إمارة رأس الخيمة عام ٢٠١٨ وعند الصرف تبين أن الحساب مغلق قبل سنة ولا يوجد رصيد. ذهبت بالشيكات جميعها للشرطة وتم سجن المتهم شهر واحد فقط والآن أمامي فقط الشق المدني. هل أستطيع الآن التقدُّم بالشق المدني؟ وهل سيرجع لي حقي؟ علمًا بأنها شركة ذات شخص واحد ورأس مالها عشرة آلاف درهم فقط، وصاحب الشركة مقيم عربي وغير مبالي وغير مهتم بالسداد، وهو الآن يمارس عمله بشكل طبيعي. ما الحل الأمثل الآن لأن رسوم المحكمة في رأس الخيمة تطلب ١٠٪؜ من قيمة المبلغ وأخاف أن أخسر أكثر مما خسرته معه وبدون فائدة تُرجَى ولا أعرف ماذا أفعل؟ أرشدوني أناشدكم بالله، علمًا بأنني تقدمت بطلب تأجيل الرسوم وتم الرفض مرتين!

إمكانية توقيف مسافر في مطار دبي لوجود قرض في قطر

س: السلام عليكم، تحياتي! كنت مقيمًا في دولة قطر حتى سنه ٢٠١٧ وغادرت في إجازة أرغمتني ظروف خاصة على تمديدها ثم التقدُّم باستقالة من البلد الذي أعيش فيه وهو بلد أجنبي أحمل جنسيته. في أثناء وجودي في قطر، اشتريت سيارة و استأجرت سكن وذلك طبعًا عن طريق شيكات مؤجَّلة وكنت أسدد قرض مالي، وكنت ملتزم بالدفع حتى غادرت البلد ولا أعرف مصير هذه الشيكات، وهل أنا مُطالَب بشيء أو مُترقَّب عودتي سواء في قطر أو أي دولة خليجية. الآن بعد خمس سنوات سأتوقف في مطار دبي ترانزيت في طريقي لبلدي الأصلي وأخشى من التعرض لأي مساءَلة من السلطات في المطار. هل يمكن للسلطات في دبي توقيفي إذا حُرِّكت دعوى بسبب تلك الشيكات في قطر؟ شكرًا لكم!
