س: بعد إعلامي للمالك بعدم الرغبة في التجديد، سلمته العين المؤجَّرة إلا أنه لم يعطني أي ورق مكتوب يفيد استلامة العين؛ فأرسلت له بريد إلكتروني يفيد بأنني سلمته المفاتيح في اجتماع لي معه ولم يرد على الإيميل بالقبول أو الرفض. هل الإيميل كافٍ أم يجب عليّ فعل شيء آخر؟

س: مرحبًا، أعمل بشركة في منطقة حرة بدبي منذ ثلاثة أشهر بعقد غير محدد المدة وفترة اختبار تمتد لستة أشهر. والآن لا أشعر بالارتياح في العمل معهم وأريد أن أستقيل حيث أنني وجدت عملاً بشركة براتب جيد بفارق ثلاثة آلاف درهم بالإضافة إلى المواصلات. هل أنا مجبر على دفع قيمة التأشيرة حيث أن هذا مثبت في رسالة العرض التي استلمتها عند إجراء المقابلة، ولكنه غير مذكور في العقد؟ الرجاء النصح ولكم جزيل الشكر!

س: كيف يمكنني معرفة ما إذا قام المطور بتسجيلي عقدي المبدئي في دائرة الأراضي في دبي، وذلك لرغبتي فسخ العقد؟ مع العلم بأنني مواطنه خليجية مقيمة خارج دولة الأمارات. أريد أن أكون على يقين قبل دفع غرامة الإلغاء 25% من صافي قيمة العقد.

س: حصل نزاع مالي وبين كفيلي حيث كنت أدين له بمبلغ ٢٠٠٠٠ درهم. قام قبلها باستخراج تصريح عمل لذا قمت بتسليمه جواز سفري لإكمال الإجراءات، ولكن بسبب النزاع قام بإلغاء تأشيرة الإقامة وتعديل وضعي وقام بالتعميم ضدي دون علمي. وقد علمت بعد ستة أشهر من قيامه بذلك لذا راجعته وطلبت منه رفع التعميم ولكن دون أي جدوى. راجعت أحد موظفي تسهيل وسألته عما إذا كان بإمكاني إدراج طلب لرفع بلاغ هروب كيدي فردّ علي بأنه لا يمكنني طلب رفع بلاغ بسبب مرور أكثر من ستة أشهر. لذا كنت أراجع مندوب كفيلي حتى يفهمه وضعي ويقوم برفع التعميم ولكن دون أي جدوى. في عام ٢٠١٤م تم القبض علي من قبل شرطة دبي وإحالتي الى شرطة عجمان وبعد شهر تم تسفيري. ملاحظة: قدم كفيلي دعوى مدنية ضدي في محكمة عجمان مطالباً بالمبلغ قبل قيامه بإدراج بلاغ هروب ضدي وقد علمت عن القضية قبل سنة من تسفيري. سؤالي هل يوجد هناك وسيلة لإنهاء البلاغ الذي قام كفيلي بإدراجه ضدي وهل يمكنني العودة إلى دولة الإمارات؟ وما هي الاجراءات اللازمة لذلك؟

Q: Hello. I`m handling the case of my client. He rented a retail unit to a company for AED 360,000 per year, 12 cheques of AED 30,000 each and additional security deposit of AED 30,000. The tenant isn`t paying his rent for the last 5 months and the tenancy is due for expiry in 31-07-19. What should we do? Send a notification message to the tenant asking to pay the missing 5 payments within 30 days otherwise, we will file an official complaint in RERA? Settlement of a loan to avoid criminal and civil actions

Q: Hi. I got a loan of 30,000 from a finance company. I was paying my monthly EMI. After that, I lost my job and I wasn`t able to pay. Then I got another job. My employer applied for a visa but my name got a match with a guy who is blacklisted in the UAE. After many attempts, I got the visa but I did not get my Emirates ID. Due to expired ID, my sim got blocked and I was not in contact with the finance company. Even to date, I don`t have an ID. Before a few months, the finance company put a case on me and I was unaware about that and I have no idea that there is running a case on me. In my absence, the court gave a judgement of 5 months in prison. I`m still in the UAE. A few days ago, I was travelling from Sharjah to Oman and they arrested me at Sharjah airport. I am on bail now. My next date in court will be in next week. I want to know is there any solution to avoid prison or convert prison to fine?
