Claiming labour dues and visa cancellation upon completing the contract
Q: I already completed the 2-year limited contract with my employer. As stipulated in their acknowledgement of my non-renewal, they will release the last salary and gratuity if I will provide any visa or plane ticket. Luckily, I was able to find a new job and while the papers are still in process, I provided them with a copy of visit visa since the new employer cannot provide a working visa unless all legal papers will be done. Even though I already gave them a copy of my visit visa, my old employer is still not giving me my last salary and gratuity. What should I do? Questions & Answers

Non-competition clause and dues upon resigning for holding salaries
Q: Dear Nadine, I have recently resigned from my company based in Dubai due to non-payment of my salary for the last three months (Apr/May & Jun 2019). I resigned on 11th June 2019 and served my notice period till 30th June 2019. My company requested to serve 30 days’ notice period which I refused to serve DUE to non-payment of salary. Finally, I requested them to cancel my visa which is under process and soon it will get cancelled hopefully by this weekend. I have also requested them to pay my dues/others which include: 1) Salary for three months 2) 6 years gratuity 3) ALL of 10 days As per my employment contract, an employee may not take up any employment directly or indirectly through a subcontractor with the client of the existing employer for a period of one year after the last day of the service period. Claiming security cheques from client for breach of contract
Q: How can we get our security cheques back given to our client against an advance for an order? Later, the LPO was cancelled after 170 days and we had already started the work for the job. We have offered to give a non-transferable credit note to the client but the client is asking us to deposit an advance given to us against the LPO in the bank account of the client and holding our undated security cheques too. The client has breached the contract by cancelling the LPO after 170 days while a part of the job drawings, structural calculations and other work were done. Can I file a case in the rental dispute centre and also claim compensation for all the trouble me and my family went through and the expenses incurred? They took AED 2000 cash, a cheque of AED 12500 dated 2nd may (which they used) and another cheque of AED 12500. After the police called them, they returned my 2nd unused cheque and AED 7000 in cash. When does the salary change after an internal position change?
Q: I am a fresh graduate who has been a full-time intern with a company that only covers transportation for over a year while completing my studies. I graduated this May. In March of this year, they offered me a full-time employment contract since I was now near completion of my degree. They still kept me on the internship allowance (AED 1000) until I submit all documents for visa processing. I have submitted all my documents for processing towards the end of May. My grace period after cancellation has also expired on the 25th of June. They are still paying me the internship allowance. Now that the visa is pending on their side, shouldn`t they be paying me the full salary? I also think they should have paid me the full salary once I signed the contract regardless of the visa status since I was already working for them. Counterclaim against two companies owned by the same owner
Q: I write to you from the UK. There are two corporate companies owned by the same owner and operating in the same territory; one of them is a property company, the second is a financial services company. The first one has defaulted on a transaction with me for £700,000. This amount has remained outstanding for the last 10 years and is a proven debt. The second company is making a claim against me for £53,000 and starts bankruptcy action against me. Does Sharia / Dubai law permit me to make a counterclaim against the second company because of the outstanding debt (£700,000) that the first one owes me? The transactions between both were separate transactions. Does Sharia Law permit a “set-off"? In law, set-off is a legal technique applied between persons with mutual rights and liabilities.
