فتح بلاغ هروب ضد موظف بعد إيقافه عن العمل ومطالبته برسوم الإقامة
س: أعمل سائقًا بأجرة الشارقة. أُوقفت عن العمل بسبب مشادة كلامية مع موظف، وبعد فترة شهرين، اتصلوا بي وأخذوا أقوالي وأفادوني بأنهم سيتصلوا بي هاتفيًا ولم يفعلوا. بعد فترة 6 أشهر، ذهبت للشركة لتقديم استقالتي وأفادني الموظف بأنني أُوقفت عن العمل وطلبوا مني مبلغ 6000 درهم رسوم الإقامة واستخراج رخصة قيادة. وبعد فترة أبلغت الشركة بعدم قدرتي على دفع المبلغ، لكن يوم إلغاء الإقامة وقبل أسبوع، ذهبت لمراجعة الشركة وأبلغوني بأن الشركة اتخذت إجراءات وفتحت بلاغ هروب من الكفيل علمًا بأنني أذهب للشركة كل شهر للمراجعة ولم يخطرني أحد إلا بعد أن ذهبت لمقر الشركة. ماذا أفعل؟ أرجو إفادتي! Dealing with inconvenience caused by neighbors in their flat

س: السلام عليكم، أقدمت زوجتي على سحب ابنتي (٤ أعوام) من المدرسة المُسجَّلة بها والانتقال من إمارة دبي، حيث منزل الزوجية، إلى إمارة أبوظبي وقامت برفع قضية طلاق بأبوظبي حيث تسكن مع أهلها وسجلت البنت بحضانة بأبوظبي. مع العلم باستمرار الزوجية حتى الآن. وقد رفعت دعوى طاعة زوجية وحكمت المحكمة بتسليم البنت لي. إذا لم تستجب الأم وأصرت على مواصلة البنت دراستها بمدرستها وقدمت تظلُّم ورُفض وتم تأييد الحكم وبعدها قامت الأم بعمل استئناف للحكم: ١- هل يمكن أن تنظر محكمة الاستئناف القضية أم سترفضها شكلاً ومضمونًا؟ ٢- هل يمكن أن يتسبب إخراج الأم للبنت من المدرسة في إسقاط الحضانة عنها وانتقالها لي بعد الطلاق؟ ٣- هل يمكن بعد الطلاق أن تُخرِج الأم البنت من مدرستها التي اخترتها وأن تجبرني على نقلها إلى أبوظبي؟ Questions & Answers

Reducing the salary of an employee before termination
Q: Hello Nicole, Greetings! I have been working in a private company in Dubai for the last 13 years under an unlimited contract. Recently, they have made my position redundant. I am now serving 3 months notice period as per the labour contract (2 months already served, I am now in 3rd and last month). My employer has put me on forced paid leave to adjust my notice period against leave days balance. I need some clarification per below, please. 1. The employer is paying me a full salary for a notice period of 3 months. However based on the recent announcement from the Ministry of Labor (for Private Co. employees), can my employer reduce my salary temporarily/permanently in this last month of notice period? 2. If the answer to question 1 is YES, how will it impact the calculation of my end of service benefits like gratuity or leave balance encashment? Will it be recalculated based on the revised (reduced) salary? 3. Am I eligible to claim any other Termination/redundancy pay apart from gratuity and leave balance encashment? Questions & Answers

Claiming EOSB after resignation from unresponsive employer
Q: I have resigned from my previous employer on 11 February 2020. I worked with the company for 10 years now. The company owes me a gratuity amount of AED 90,000. They earlier assured me they would pay my end of service in part. However, they have been ignoring my emails, phone calls, Whatsapp messages...etc. It`s been almost more than 45 days now. Can someone let me know how can I proceed legally with this and will I get my end of service? They have been doing this to other previous employees and don`t care about the UAE law.
