How to find a missing person?

Q: Good day, My workmate was missing 2 days now. We track his flat and check his whereabouts and found out he was last seen at a billiards place near his house. Two guys from the billiards place informed us that he and 3 more (2 guys and 1 lady) was taken by the CID. We went through the police station in Al Murraqabat and the police there said that his name is clear and he is not detained or jailed. How can we find him now?

إصدار تأشيرة عمل رغم وجود حكم بسبب قرض. ماذا أفعل؟

س: كان لدي قرض بمبلغ ٦٠٠٠٠٠. دفعت أكثر من ٤٠٠٠٠٠ ثم فقدت عملي لمدة ٣ أشهر. قدموا ضدي بلاغ جزائي من ٤ سنوات وبلاغ مدني من سنة. استأنفت فشطب القاضي الاستئناف وصدر حكم بمبلغ ٤٠٠٠٠٠ أي بفائدة ٢٠٠٠٠. صدر ضدي ضبط وإحضار من ثلاثة أيام. كل مرة أقدم طلب تقسيط على ٤ سنوات بدفعة أولى ٢٠٠٠٠ يُرفَض! أريد عمل فيزا ولا أستطيع. وجدت عمل بقيمة ١٥٠٠٠. لدي نفقات بقيمة ١٥٠٠٠. ماذا أفعل؟ أرجوا المساعدة!

What are the consequences of unpaid debt on the guarantor?

Q: I guaranteed a bank loan for my company although I`m not a shareholder. The owner guaranteed too but he resides in South Africa. The South African business owes the UAE business AED 850k and the bank loan outstanding is AED 880k. I am owed AED 1000k in unpaid wages/personal loans to the company. Can the bank come after me for loan settlement (payments are currently up to date) if there is a default even though I`m owed more than they are?

Q: Hello legal advisers and lawyers, What is the compensation I can get from my employer`s violation and abuse of me? - No days off. - 12 hours working per day for 4 months. - On my 5th month it became 24 hours work per day and they give rest only 3-4 hours a day then back to work. For the whole month, even I was crying for refusal. - Not enough food. - Not paid fairly according to working hours. - Refusal from the medical test. - No visible contract. - No medical insurance. - Forced to work 24 hours against my will and reason for me to get too sick, restless and sleepless. - Passport was confiscated by my employer. - Emirates ID was also confiscated by them. - These are the reasons why I left my job to save myself from possible death.

The inclusion of weekends in the calculation of the annual leave

Q: Hi, This query is being posted to seek clarification on another query that I saw on this website. Scenario 1: A company is off on Friday and Saturday and one of its employees wants to take annual leave on Thu (Dec.20) ONLY. He will rejoin on Sunday (Dec. 23). His annual leave entitlement is 30 days per year. Scenario 2: He takes annual leave from Thu (Dec.20) to Sun (Dec. 23) and rejoins on Mon (Dec. 24). As per Article 77 of the Labour law, the calculation of the duration of annual leave shall include national holidays specified by law or weekends if they fall within the annual leave. For scenario 1, the advice from one of the lawyers was that 3 days will be deducted. How can the weekend be included in the annual leave as it doesn`t fall BETWEEN or WITHIN the annual leave? It falls after the annual leave. Moreover, the employee needs only one day`s leave and if permitted, he would have worked on the following day but the company does not work on Friday and Saturday. Thanks!

Changing the employment visa while a bounced cheque case is pending

Q: Presently I have a Dubai employment visa. I have a bounced cheque case by the bank due to the nonpayment of EMIs and they filed a case and the case is still going on in the Abu Dhabi court. I got a job offer and I want to change the job to Abu Dhabi and the company wants to give me Abu Dhabi visa. So can I change the job and get the Abu Dhabi visa from the new company? Will there be any problem in getting Abu Dhabi visa?

What are the rights of employee in case of redundancy due to COVID-19?

Q: I was terminated from employment in June 2021 after receiving and working 1 month`s notice. I was on an unlimited contract. I am still waiting for 2 months` salary, gratuity and leave payment which my employer accepts is due but still not paid. I have raised a complaint with MOHRE and have the approval to go to Court. However, I was terminated as a result of the employer citing that due to COVID-19 they need to reduce salaries by 30%, letter dated 22nd Apr 2021. As I refused to sign, I was then terminated, via a letter dated 3rd May 2021, which stated "due to restructuring", my position had become redundant. The question is - Am I able to claim Arbitrary Dismissal for up to 3 months salary for the unfair termination?

The restriction to travel to the UAE is still valid while the bank issue is cleared

Q: Hello, My inquiry is in connection with a restriction placed on my wife from entering the UAE. In May this year, we flew to the Dubai airport. I was cleared but my wife was not. Please note that my wife never lived in the UAE although we both lived in Qatar. We contacted Qatar and consequently cleared the issue she had with a bank and was given a clearance letter from the bank. However, the restriction in the UAE is still valid even after we had settled the original issue. This has been ongoing for the past 3 months. I will like to engage a legal service to help us resolve this and obtain a police clearance.
