Can I send an eviction notice to the tenant immediately after purchasing a property?

Q: Dear All, I`m in the process of purchasing a property in Dubai, which is currently rented. The rent expires on 29th Feb 2024. I`m hoping to serve a notice as soon as the property is transferred into our name. Assuming we complete a transfer on 30th October, can we issue a notice immediately with the intention that it will be vacated on 30th Oct 2024? Are there any options to evict the tenant earlier and move in ASAP? We are planning to live in the property, as this would be our main family home.

Can the landlord send me an eviction notice just to rent the property for a higher price?

Q: Greetings, I`ve been renting the property I`m living at for one year now. The contract was renewed and we agreed on an increase a bit beyond the 5% specified in the contract. 3 weeks before renewing, I was contacted by a real estate agent "coordinating the contract renewal". I found out later that this agent offered another tenant who would pay about 20k more for renting the property. But my landlord couldn`t just kick me out because we already agreed on renewing and he has to give me a 1-year notice. We renewed the contract and signed it, and 2 weeks later, I received an eviction notice on my email. When I asked my landlord about it, he said "I need the property to be vacated so that I can live in it". He has about 12 properties he rents, and out of the blue now he wants to live in this specific one where this "agent" is offering tenants a higher rent. Is it even legal to give an eviction notice so that he can charge higher rent? What can I do now?

Q: I am staying in a rented house in JLT, Dubai. My lease agreement is due for renewal today on 1st Sep`23. The landlord had sent me a notice 3 months earlier asking for a rent increase of 15%. I responded to him the same day and showed him that the RERA rent calculator showed no increase. He agreed through his agent (verbally) to keep the rent the same as last year. Today he sent me a notice that he wants me to allow viewings of the property to third parties as he wishes to sell the property. Can he force me to vacate the house or allow these viewings? Does he not have to give me 12 months` notice as my lease renewal date is today and he is yet to sign the new lease with me? What rights do I have if he doesn`t sell the property and gives it to someone else at higher rent after I vacate the house?

How to cancel a partner expired visa while the other partner is not in the country?

Q: Hi there, My mother is on a partner visa which expired on August 31, 2023. We were trying to cancel the visa but were unable to do so because: 1) The other partner is not in the country currently. 2) The trade license has not been renewed over the last year. Will the visa automatically expire now? Is she allowed to leave the country? If she leaves, can she return later on another visa or a new visa? Does she have a grace period after the expiry date of the visa?

Q: I applied for fat-freezing to reduce weight with one company. They said they would give sessions for 4 months. I made all the documents and signed a consent form, and they made an EMI from Tabby for 4 installments. I made one installment and took only 3 sessions. But their services are not good and they gave me scars and red bruises near my stomach and love handle side. I didn`t continue the session further and I told them to cancel my further session and the other 3 installments to reverse them so I don`t need to pay when I am not using their services further. They are not canceling my installment and saying I need to continue the session and make payment. What can I do as an option? They are not reversing my other installments for the service which I didn`t use. They are still saying I need to pay despite all the scars I showed them near my belly side scars because of their fat freezing. They promised me it would be painless, I got scars and bruises but they are not willing to reverse and cancel my other 3 EMI installments. Please guide.

How will the gratuity be calculated if the company changed my contract and salary?

Q: Dear Sir, I started to work in a company on 28-Feb-2012. In 2014, due to a change in the name of the company/license, they canceled the visa and gave me a new visa to continue. While they changed my visa, they gave me 2 years of gratuity/EOSB. After that, in June 2020, my package was changed due to a specific contract & accordingly, the MOL contract document was changed for visa processing. The changed package is more than previous. Now I have resigned, Please advise; 1. What will be the timeframe to calculate the EOSB (from 2012 or 2014)? 2. Would I receive a gratuity based on my current basic income for the whole year of service (2012/2014 to 2023 Sep.) or my previous pay scale (up to year 2020) & 2020 to now with my current pay scale?

Q: Dear Sir/Madam, I have applied for bail for my husband on the Public Prosecution website. He was sentenced to 6 months in prison for a criminal case, fined, and deported. He has now served 7 months in prison. He has a pending civil case, and a lawyer advised me that I can apply for bail, so I did. The application states that a decision will be made within 5 days. Does this mean I will receive a decision on the 5th day, or any day within 5 days? What are the chances of him being granted bail? Thank you!

Can the landlord evict me from apartment for personal use if he lives in his own property?

When I contacted the travel agency`s customer service, they told me that the ticket will be provided in the morning. I requested a refund and they replied that the amount will be credited to my account within 25 days. It has been almost 2 months and I have not yet received the refund. What are my rights as a tenant in Dubai if the Ejari is blocked?

Q: Dear Sir/Madam, I have just moved into a new apartment as a tenant. The tenancy agreement was signed by all parties (the landlord and me), and the cheques were signed and submitted (the first of four has been cashed). I have tried to get Ejari using the REST App, Dubai Land Department website, and in person at the kiosks, but they have been denied/blocked because of a legal case between the previous tenant and previous owner (I moved in the day the new owner purchased the property). The new owner wants to evict me and is saying I must leave. Without Ejari, I have not been able to register the tenancy agreement, and I cannot even get Dewa (it is currently under the name of the new landlord who is threatening to shut it off). The landlord says that because there is no Ejari, I have no rights and I must leave. Do I have to leave as the landlord is saying? Is there a course of action I can take?
