What to do in case of property delay in handover and how to claim refund?

Dear Lawyers,

I have invested in two properties with a developer back in 2018 and paid an amount of AED 535,000 in total.

The handover was due in Q1 2020. Until now the progress is showing 17% only on the DLD website which indicates they might not be able to deliver anytime soon.

How can I get a total refund of my paid money and what are the legal steps that I should follow with the developer in terms of the notice period and everything?

Dear Questioner,

You can file a case for termination of the Sale and Purchase Agreements and claim a refund of the total amount paid along with compensation.

Further, we need to review the terms of the Sale and Purchase Agreements to give you appropriate legal advice.

Kindly send us a copy of the Sale and Purchase Agreements in our email so that we can review the same and guide you with the next steps.

Thanks

Dear questioner,

As the developer has defaulted on its basic duties by delaying the handover of the property, you have full rights to terminate the mutually signed contract and ask for a full refund of all your investments done with the developer to date

We have handled cases like this with 100% success in the past. We need to review the mutually signed SPA in order to assist you properly.

Kindly contact us directly by phone or email for a detailed discussion.
