I am renting from the landlord since 3 years now, all payments are done on time and even I am doing maintenance for things in my house which I am not supposed to do but to maintain the property in good shape out of goodwill. I received an email from my landlord asking for renewal as per the agreement, 3 months prior to the termination of my current contract. I visited them and handed over the new cheques for the new rental year in advance and signed the new tenancy contract. Now I discovered that he may be selling the property and may not renew my contract despite receiving my cheques and delaying EJARI renewal. I still have 2 months to go in the current contract. my question to you is, are they allowed to renew or to compensate if they already took my cheques for the new year rental and exchange of emails with the same is available? Q: Hi, My company terminated my contract on 5-01-2021 with a termination letter effective the same day. I was forced to sign that letter and leave the premises. Therefore, they were breaching the contract as the contract stipulates that 30 days notice should be given. I started working for them in 07-11-2019, due to coronavirus I accepted unpaid leave for 15 days in May, 15 days in October and a whole month in December 2020. I filed a complaint and they sent me emails telling me to accept AED 10,637.07 as a total of what they owe me. Today, they want to add AED 7000 to this total but the issue is that it is not even close to what they really owe me. End of service, annual leave (0 paid leave so I should receive the full amount), notice period salary (full amount), air ticket and compensation (1 to 3 months negotiable as per the UAE law). I would like to know what should be done if they still don`t comply with the UAE law. Thank you in advance

Q: I have been working on a limited contract with a company for 4 years. I kept on renewing the same contract every 2 years (2016 to 2018 and 2018 to 2020). Two years ago, in Dec 2018, I renewed the same contract. This year, in Dec 2020 (my visa expired on 28 Dec 2020) so I completed my visa and I’m not renewing my visa. I resigned from my job and I am serving my notice period for one month. Will I get my gratuity?

Resignation and visa cancellation in Dubai while delegated to another country

Q: Hi, I was employed in a free zone in Dubai but worked in Saudi Arabia on a business visa. Can I ask for any compensation for it if there is nothing related to this in contract? Also, I resigned and served the notice period in Saudi Arabia only and then the company sent me back to the UAE for visa cancellation process as I need to take the final exit. In this case, am I eligible to get the salary until my visa get cancelled or just the for the notice period? Because after the notice period is over I did not work and being an expatriate I have over expenses because of this delay. Thanks

س: أنا طبيبة أسنان فُصلت من العمل. رغب صاحب العمل في أن يدفع لي بدل شهر واحد لكن عقدنا ينص على مهلة 3 أشهر. أخبرته أنني أرفض تعويض الشهر وأنني مستعدة للدوام لمدة 3 أشهر حسب العقد. لا حاجة للعيادة لدوامي مع المرضى لأن الطبيب البديل موجود. طلبوا مني الدوام 3 أشهر بمهام مكتبية حتى يجبروني على التخلي عن حقوقي، بحكم أن عقد العمل بيننا ينص على أن المُسمَّى الوظيفي لي "مساعد مدير". هل يحق هذا لصاحب العمل؟ هذا مع العلم أنه توجد إثباتات أن طبيعة العمل لدي كانت أخصائية تقويم أسنان، وأن لدي رخصة من هيئة الصحة تدل على أنني مُرخَّصَة في هذه العيادة بالتحديد؟ أم أن الذي يحكمني هنا هو فقط عقد العمل والمسمَّى الوظيفي فيه؟

Q: What is the procedure to obtain an amicable divorce settlement following the family reconciliation center clearance? Is a lawyer required to draft the settlement? Can the lawyer liaise with the opposing party to reach the settlement? If a NOC is sought from the reconciliation center, does the case automatically move to the court for a discussion on the financial settlement? Or does the wife need to file a separate claim for the procedure?

The time frame of the execution process in a labour case

Q: Dear Madam, I have a labour case with my previous employer (private company). It started approx 10 months back and court judgement came in favour of me. I am following up with the execution court to get my money. As advised by them, a request was submitted to block the company trade license, letter to banks where the company holds an account was sent in order to transfer money to the court. Question 1) How long will the procedure take to get my money? (Please note that its a private company and they are still working) Question 2) Meanwhile I got an information that they are fabricating a false case against me to counter this stating that I didn`t do my job properly and made a mistake that caused damages to the company. Will the court accept such cases? And what action shall I take in such case? Your response will be highly appreciated.
