س: السلام عليكم، أنا امرأة متزوجة منذ عشر سنوات وأعاني الكثير من المشاكل الزوجية من الضرب والإهانة والسب والشتم من قبل الزوج وأهله ولدي طفلان. لم أعد أستطيع التحمل حيث أن أهل الزوج لديهم إقامة ويقيمون لدي أم وأب وأخت وهم سيئون جدًا وأطفالي يتعرضون للضرب منهم والضغط النفسي حيث أنني أيضًا لم أعد أستطيع التحمل وأشعر بالتعب بالقلب والجسد. مع العلم أني أطلب منه الطلاق ولا يقبل ويمتنع عن إعطائي مصروفي وحقوقي كاملة، وأصبح الآن يضغط علي بترك العمل وأخذ مني سيارتي. ما القضية الواجب رفعها في المحكمة؟ هل يجوز الخلع دون خسارة حقوقي؟

Can a property buyer claim travel ban as force majeure for not fulfilling MOU?

Q: Hi, I have signed an MOU in the month of April 2021. After signing, I went to India to attend my brother`s marriage. I was planning to come back after the marriage but by that time, the UAE government put a ban on travel from India to UAE. The ban just got lifted and I returned in Mid August 2021. Unfortunately, by the time I returned, MOU got expired. Since I was planning to purchase the property on mortgage, I needed to be here in the UAE to complete the transfer. I still have all the intentions to purchase the property but the seller has increased the price which doesn`t fit my budget. Now my question is, since the reason for not completing the transaction was genuine, do I have any legal stand in this case?

Rights of the tenant in case of receiving an eviction notice

Q: The landlord wants to provide us with a 12 months` notice to evict but has not provided a reason. We have advised him of the 4 reasons as per RERA in which he can do this and that he cannot rent the property to another tenant for 2 years if he proceeds with this. He has ignored this and now asked to inspect the property next week. Obviously, as he has given notice we have to allow this. Where do we stand in protecting ourselves? It is quite clear he wants us to leave as the rent in our area has increased significantly but the RERA calculator is not allowing any rental increase.

Q: Good day, My workmate was missing 2 days now. We track his flat and check his whereabouts and found out he was last seen at a billiards place near his house. Two guys from the billiards place informed us that he and 3 more (2 guys and 1 lady) was taken by the CID. We went through the police station in Al Murraqabat and the police there said that his name is clear and he is not detained or jailed. How can we find him now?

What are the consequences of unpaid debt on the guarantor?

Q: I guaranteed a bank loan for my company although I`m not a shareholder. The owner guaranteed too but he resides in South Africa. The South African business owes the UAE business AED 850k and the bank loan outstanding is AED 880k. I am owed AED 1000k in unpaid wages/personal loans to the company. Can the bank come after me for loan settlement (payments are currently up to date) if there is a default even though I`m owed more than they are?

Q: Hello legal advisers and lawyers, What is the compensation I can get from my employer`s violation and abuse of me? - No days off. - 12 hours working per day for 4 months. - On my 5th month it became 24 hours work per day and they give rest only 3-4 hours a day then back to work. For the whole month, even I was crying for refusal. - Not enough food. - Not paid fairly according to working hours. - Refusal from the medical test. - No visible contract. - No medical insurance. - Forced to work 24 hours against my will and reason for me to get too sick, restless and sleepless. - Passport was confiscated by my employer. - Emirates ID was also confiscated by them. - These are the reasons why I left my job to save myself from possible death.

The inclusion of weekends in the calculation of the annual leave

Q: Hi, This query is being posted to seek clarification on another query that I saw on this website. Scenario 1: A company is off on Friday and Saturday and one of its employees wants to take annual leave on Thu (Dec.20) ONLY. He will rejoin on Sunday (Dec. 23). His annual leave entitlement is 30 days per year. Scenario 2: He takes annual leave from Thu (Dec.20) to Sun (Dec. 23) and rejoins on Mon (Dec. 24). As per Article 77 of the Labour law, the calculation of the duration of annual leave shall include national holidays specified by law or weekends if they fall within the annual leave. For scenario 1, the advice from one of the lawyers was that 3 days will be deducted. How can the weekend be included in the annual leave as it doesn`t fall BETWEEN or WITHIN the annual leave? It falls after the annual leave. Moreover, the employee needs only one day`s leave and if permitted, he would have worked on the following day but the company does not work on Friday and Saturday.
