The right to claim refund for delay in handover after failing to complete instalments

Q: I have purchased a studio in Dubai, 30% was paid already (AED 171,000). The handover is getting delayed already 4 months, the developer is already in his grace period for handover but the apartment is also not registered in DLD. I have paid almost all that I have but I am not able to pay anymore because of some financial issues. Will I get my money back? Would it be possible to pay a lawyer after execution not in advance? Notice period and gratuity of the employee who resigns due to salary non-payment

Q: Hello, I am on an unlimited contract with a free zone company in Dubai. I haven`t been paid my salary for many months. I decided to resign under article 121. Question 1: when calculating my gratuity, is it considered as Resignation or Termination? Question 2: if I have a 3-month notice, resigning under article 121 entitles me those additional 3 months? Q: Hi Madam! I have been working in a firm for the past 2 and a half years. In April 2021, I went to India for one month vacation. Due to the Corona crisis, flights have been suspended until August. In June 2021, my visa and labor card have also expired. As per the UAE government, in August I came back to Dubai and started working. Last week, I resigned from my company. They informed me that I don`t have to stay the notice period and they will cancel my visa in 2 to 3 days. But to date, they haven`t started the procedure. Kindly advise If there will be any fines imposed against me.

Q: Hi, I used to work in a company (clinic) as an account manager. In August, the employer terminated my contract orally and I acknowledged the termination via email. On 13 Sept 2021, my visa was supposed to be canceled but they requested me for one more day and I agreed. So on the 14th, they canceled my visa. Before cancellation, I received my final settlement. I joined a new company and I am currently employed by the new company and my status has been changed. The ex-employer offered me a couple of times to come back but I refused. Now they are aggressive and they are pushing me to go back to the office as there are some issues in the accounts. التوقف عن دفع أقساط العقار بسبب تأخُّر المطور في التسليم

س: سلام عليكم، قام المطور بتقديم رسالة فسخ عقد بسبب تأخُّري عن دفع دفعة أخيرة فقط بقيمة ٧٥ ألف من أصل ٣٧٥ ألف. سبب تخلفي عن دفعها هو تأخُّره عن إكمال المشروع بما يقارب ٣ سنوات. أثناء تقديمه للرسالة، أبرمنا اتفاقية ودية بأن أدفع المبلغ على دفعات بسبب عدم قدرتي حينها. دفعت ٢٠ ألف وبعدها ٢٥ ألف في غضون ٣ أشهر وهي المدة التي كانت فيها الرسالة قيد التنفيذ من الجهة المرسلة. بالرغم من إرسالي كافة المستندات للجهة المرسلة إثباتًا للدفع، إلا أنه تم إكمال الإجراء وفسخ العقد. مع العلم أنه عند مراجعتي للجهة المسؤولة وإثبات أنني قمت بسداد ٤٤.٣٪؜ من أصل ٥٠٪؜ قبل إيصالي رسالة فسخ العقد، لم يقم المطور بإعطاء بيانات كاملة عن دفعاتي وبالتالي اتخذت الجهة قرار فسخ العقد مع علمها بعد ذلك بأنني سددت ٤٤،٣٪؜ ولكنها طالبت المطور بإرجاع الوحدة ولكنه باعها لمشترٍ آخر فور حصول على نسخة فسخ العقد. إلى الآن المطور لا يجيب ولم تتخذ الجهة أي إجراء ضده وفي الأخير أهدرت أموالي. سؤالي: هل لي مقتضى مما ذكرت بشكل قانوني؟ وبأي طريقة أستطيع رفع دعوى قضائية ضده للتعويض؟ ما تكلفتها؟ وهل قضيتي مضمونة باسترجاع المبالغ؟ إن كانت نعم، فكم تستغرق؟

An employer asks the employees to sign cheques to get their salaries

Q: My previous employer had a policy where we had to give him a cheque for 15,000 AED addressed to the company in order to receive the salary. This way we could not leave the company before finishing the contract. I had no choice during that period as I wanted a job badly and gave the cheque. In return, I sent an email to the company stating that I am giving the cheque as per the company`s request and I haven’t taken any loan from the company. In 3 months, I got fed up with various unfair policies in this company and left. I didn’t sign a labor contract with the company as I was working on a visit visa. When I left, I requested my cheques back but got no response. Just yesterday, this company bounced my cheque. Can I go to the police and complain against this employer? What are my options now?

Q: A criminal case against cheques is completed and sentenced to jail. The accused is right now in Kazakhstan, Almaty. What can be done next to get money back? Is there any law firm with experience with such a case?

A client cancels the contract and refuses to pay. What to do?

Q: Dear sir/madam, We were contacted by a large firm in the UAE. We agreed, put a contract, and got an LPO from a client. It was a 6-week project. We started & followed all the processes, got approvals for each task as per the approved project plan, did revisions they requested. For a few items, we needed the client`s feedback or inputs but they didn`t provide them at all. For 4 weeks, we sent reminders, calls, emails. No response or updates. It was affecting us; 6 weeks is over. Today, we got an email saying they are canceling the PO and not paying at all. The PO clearly states "partial payment" is included. Our contract states delays caused by clients are their fault and are payable. We have full proof of work, emails & records. We want to take legal action and get compensation for all work done, delays, time wasted, and damages as we had to stop other work. Please advise!
