س: السلام عليكم، كنت شريكًا لشخص في محل موبايلات منذ سنتين وكان الجزء الخاص بي هو الأقل، الربع، ولكن كنت أدير عملية البيع في المحل. جعلني شريكي أوقع له على إيصال أمانة على بياض كنت قد بصمت عليه. انفضت الشراكة منذ 6 أشهر. تواصلت معه بشأن الإيصال فأخبرني أنه لم يجده وسيبحث عنه ويرسله لي. كلما تواصلت معه بشأن هذا الموضوع قال لي نفس الكلام ولم أظن فيه سوءًا. منذ حوالي شهر كلمني بشأن شخص كنا نتعامل معه وهو مدين بمبلغ منذ حوالي سنة ونصف ولا يستطيع تحصيل المبلغ منه. قال لي شريكي أنه إن لم يحصل على المبلغ من ذلك الشخص فسيشكوني أنا بالإيصال. مع العلم أننا أنهينا كل شيء عند فض الشركة. ما الحل؟ وكيف أحفظ حقي إن رفع دعوى ضدي؟

Is the buyer obliged to buy an off-plan property upon sign the booking form?

Q: Hello, We wanted to buy an off-plan property. Unfortunately, the CEO of the developer ran away for financial reasons and RERA took over. We only signed the booking form but none of our money has been taken. The SPA was also never signed. Can we just move on and look at other properties or can RERA ask us to pay the amounts if they decide to choose another developer to finish the project? Thank you for your help.

س: السلام عليكم، من فضلك لدي استفسار. صدر حكم نهائي من المحكمة بمستحقات عمالية لي منذ يوليو 2020 ومنذ ذلك الحين تقدمت بإجراءات التنفيذ ولكن لا يوجد أي تقدُّم ولم أتحصل على أي جزء من أموالي المستحقة. القاضية رفضت قرار الضبط والإحضار لمدير الشركة ورفضت أيضًا قرار منعه من السفر. مر أكثر من عام الآن والمستحقات مستحقة منذ 2017 وصاحب الشركة مستقر في دبي ولديه شركة أخرى. محكمة التنفيذ ترفض اتخاذ أي إجراءات لتحصيل أموالي. ما الذي يمكن عمله من إجراءات تنفيذ لتحصيل مستحقاتي.

س: السلام عليكم، بعد التحية، أقيم في شقة بالدور الثامن علوي وفوقها 3 أدوار مكونة من أعمدة خرسانية وأسقف فقط وتم إزالتها من قبل الجهة الإدارية المسؤولة مما أدى إلى شروخ في أعمدة الشقة والأسقف والجدران وأيضًا أصبحت بالدور الأخير من العقار بعدما كنت في الدور الثامن ويعلوه أكثر من طابق. أريد أن أسال بخصوص حقي في المطالبة بالتعويض أولاً لما تسببت به الإزالة من إلحاق الضرر بالشقة وثانيًا لما تسببت به الإزالة والوضع الحالي من انخفاض قيمة الوحدة بالسوق على اعتبار أن الدور الأخير صار أقل بنسبة 30% من قيمة الوحدات السكنية الأخرى. أرجو الإفادة. مع جزيل الشكر والامتنان!

Q: I got married on 1 February to a man who works in Dubai for the last 13 years. I came to Dubai with my husband on 17 February and stayed together for 5 months. On 21 July, I came to India to my in-laws` house. My in-laws told me that I should ask for dowry money from my maternal family, otherwise, I will get divorced. Now I want to know that if I come to Dubai, and if I want to do a safety case against my husband, will the Dubai Police get me justice?

The applicability of non-compete clause when moving from a mainland to a Freezone company

Q: Good morning, I am writing to inquire regarding the non-compete clause. I just resigned from my previous company. I worked as admin staff and I did not have any supervisory roles, nor handle any financial responsibilities. I work for a mainland company in Dubai. Recently, I received a job offer from a competitor to do the same role. The competitor is DMCC and I will be under a Freezone visa. My employment entry permit has already been issued and I am just waiting for my residence visa to be printed. My previous employer threatened me that they will sue me because I signed a non-compete clause with them that should be effective for two years after I resigned. I am wondering if the non-compete restriction will apply to me given that I will be joining a Freezone company this time? I held a non-supervisory/admin level position in my previous company.

رفع دعوى لدى محاكم الدولة رغم وجود شرط تحكيم دولي

س: عقد فيه تحكيم دولي ومقاول الباطن أتمّ الأعمال وتم تسليم المشروع ولكن المشروع كان فيه تأخير ومقاول الباطن وصل مرحلة الإفلاس ولا يستطيع الذهاب إلى التحكيم الدولي. رفع قضية إثبات حق وبالفعل تم تعين خبير هندسي وحسابي وبعد الانتهاء من الاجتماعات مع كلا الطرفين وإيداع كل منهم الأوراق الثبوتية، أظهر التقرير أن مقاول الباطن له حق فوق 22 مليون درهم. المقاول الرئيسي دفع في أول جلسة بشرط التحكيم. مقاول الباطن في حالة إفلاس وهو الآن مُعرّض للسجن بسبب القضايا المتراكمة عليه من البنوك والموردين. هل يُسجَن ويضيع حقه بسبب شرط التحكيم؟ وهل هناك حل بإنهاء القضية عن طريق محاكم الدولة كونه وصل مرحلة الإفلاس وبالفعل رفع قضية إفلاس ولكن تم رفضها لكون رخصته التجارية منتهية وعليها حجوزات؟ ما الحل في هذه الحالة؟ أرجو من أهل الخبرة الإفادة! شكرًا لتعاونكم!
