الإجراء الصحيح لتسوية الدين ووقف الاقتطاع من الراتب

س: السلام عليكم، قضية مطالبة بإخلاء مأجور وبدل إيجارات. صدر حكم لصالح المؤجِّر وتم رفع قضية تنفيذية وبموجبها تم الحجز على جزء من راتب المستأجر الذي يعمل موظف حكومي. المستأجر أخذ إجازة بدون راتب من عمله وبذلك توقف الاقتطاع لصالح حساب القضية وتبين لاحقًا أن القضية التنفيذية متروكة. ماذا يترتب على الترك؟ وما الإجراء الصحيح لتسوية الدين ووقف الاقتطاع من الراتب حال عاد المدين إلى عمله؟

المطالبة بالإيجار والتعويض لدى رغبة المستأجر في ترك الشقة بعد شهرين فقط

س: السلام عليكم ورحمة الله وبركاته، أسعد الله مساءك، أخ أسامة! لدي شقة مفروشة (الأردن) أجرتها بعقد سنوي يبدأ من 01/05/2022 وينتهي في 30/04/2023. أبلغتني المستأجرة بعد شهرين وعشرة أيام تقريبًا أنها ستسلمني الشقة بحجة أنها اشترت شقة، وهي موقعة على العقد السنوي. السؤال: هل يحق لي مطالبتها بباقي المدة؟ وهل يحق لي تأجير الشقة؟ ما المدة التي يمكن أن تستغرقها المحكمة بعد توجيه الإنذار العدلي للفصل في القضية؟ وما قيمة التعويض المتوقع إن وجد؟ علمًا بأن المبلغ المتبقي عليها هو 4050 (9) أشهر.

Asking a tenant to pay more rent and threatening to disconnect the DEWA

Q: Dear sir/madam, I signed a contract F with a seller to buy his house. I asked the seller to move into the house prior to signing the transfer document, and he agreed under the condition that I pay him a rent until the date our bank clears his mortgage. After moving into the house and once his loan was cleared, he sent me an email and asked for more rent and threatened me to cut the DEWA. The transfer should happen next week, what is my legal position? As per the contract, he is obliged to come to the signature. I told him that if he disconnects the DEWA and asks me to leave the house, then he is breaching our initial rent agreement, based on which I moved to the house. Can he know use this in court by not coming to the transfer date appointment, saying that I didn`t pay him rent? I confirmed many times that I will still pay the rent we agreed on in the first place unless he cuts the DEWA or ask me to leave. Please advise!

تخفيض النفقة بسبب ترك العمل واستعادة جوازات الأبناء

س: السلام عليكم، طلقت زوجتي في فترة كورونا وكنت خارج الدولة ورجعت بعد غياب سنتين بسبب الظروف وكانت المحكمة قد حكمت بإبقاء جوازات سفر الأبناء مع الأم ونقل إقاماتهم عليها. رجعت للدولة ودفعت كامل النفقة المقررة للسنوات السابقة. لدي سؤالين من فضلكم: 1. لا أعمل حاليًا وأبحث عن عمل، فهل أستطيع أن أطلب من القاضي تخفيض النفقة بسبب عدم العمل وأنني أبحث عن عمل؟ 2. عند حصولي على عمل وعمل إقامة لي، هل أستطيع رفع قضية للمطالبة بإعادة إقامات الأبناء عليّ أنا الولي الأب وإبقاء جوازات سفرهم عندي بحكم أنني الولي عليهم، ولا مانع لدي من تسليم الأم الجوازات في حالة الطلب؟ هل ممكن أن أرفع قضية بهذا الخصوص للإقامات والجوازات لإعادتهم لي بحكم أنني مقيم في الدولة ولدي دخل ونفقة وأنا ملتزم بها؟ وهل سيوافق القاضي بحكم أن الولي مقيم في الدولة ويجب أن تكون الجوازات والإقامات عليه؟ وشكرًا لكم!

توجيه اتهام لموظف بعد استقالته والتوقيع على إخلاء طرف

س: السلام عليكم، استقلت من شركة قطاع خاص ووقعت على إخلاء الطرف. هل يحق لتلك الشركة توجيه أي اتهام لي بخصوص فواتير أو غيره سواءً كانت تلك الفواتير أثناء عملي أو غير ذلك؟

The landlord refuses to fix any major issues in the property. What to do?

Q: Dear sir/madam, I am terminating my tenancy contract with my landlord. He gave me an eviction notice in May and since then he has refused to fix any major issues in the property saying that "I`m free to fix it at my own expense", forcing me out of the property. Given these conditions, am I on the obligation to pay the 2 months` penalty for early termination? It seems to me that he waited until the contract was renewed to give me an eviction and force me out.

A tenant did not receive the email of rent increase. What to do?

Q: Hi, My landlord, through his agent, sent an email for a rent increase 86 days before my lease expires. The mail, unfortunately, went to the spam folder & was deleted before I could reply to it. I reached out to renew the contract. The landlord is insisting I renew at the rent mentioned in the mail as there was no response earlier and has even threatened eviction. Can I challenge this? Or can my lack of response to the earlier communication be taken as being an agreement to the new rent?

The HR is asking an employee to work after his resignation. What to do?

Q: Dear sir/madam, I am working as a sales staff for footwear leather products in Dubai for more than 3 years. I submitted my resignation letter last July 31, 2022, and my last day will be on August 31, 2022. I did not put my reason in my resignation letter but when asked, I said that it is personal and I need to go to my home country, however, our HR/accountant wants to extend it until September 20, 2022. His reasons were there will be no staff because some staff will be on vacation. I need to arrange my final settlement. He also said that I’m selfish because I don’t want to support the company. Non-renewal of a tenancy contract after confirming its renewal

Q: Dear sir/madam, I have confirmed to renew my apartment tenancy contract with my apartment`s management team three months before the expiration date (as per the contract) via email, after which no renewal contract was signed. Now, one and a half months before the expiration date, can I decide not to renew the contract without any penalty? Is the written confirmation via email previously taken as legal in Dubai?

الأب تنازل عن الجنسية ولم يدفع نفقة الأبناء منذ 19 سنة. ماذا تفعل؟

س: السلام عليكم، لدي بعض الأسئلة بخصوص قضية نفقة. مطلقة لديها أبناء ووالدهم لا يدفع مطلقًا وتحسبًا لصلة الرحم والبعد عن المشاكل، استمر الوضع كما هو عليه لمدة ١٩ سنة بدون أن يدفع الوالد أي مصاريف نهائيًا، مع العلم أنه مقيم خارج البلد. صدر بالفعل حكم من المحكمة بنفقة قيمتها ٤٠٠٠ جنيه شهريًا بعد ١٩ سنة. هل هناك قضية تجبر الوالد على دفع مصاريف مدة الـ١٩ سنة؟ وإذا تنازل الوالد عن الجنسية المصرية، فهل ينفَّذ عليه حكم المحكمة هذا؟ أم يلزم ساعتها أن يصدر الحكم من محكمة البلد الذي يمتلك جنسيته الوالد؟ آسفة على الإطالة وتحياتي!

A police clearance certificate is rejected. What to do?
