I served my tenant a 12-month eviction notice but he refuses to leave

Hi

I had served a 12-month legal notice to my tenant to vacate my apartment.

He had agreed to leave at the expiry of the contract which is 14 Nov.

But now he is saying that he will not be vacating till his new apartment is ready.

How can I evict him on the due date as I need the apartment for my own use from the 15th?

You can file a complaint against your tenant for non-vacating your house as per the contract and the notice given to him.

Dear User,

If you have served the eviction notice as per the legal requirements; (1) By notary public or registered mail and (2) 12 months notice period.

If these conditions are satisfied then the tenant has the legal obligation to vacate the unit. If the tenant does not vacate, you may file a case or file a complaint at the Rental Dispute Centre (RDC).

The only way is the court. You need to get him out by court power.
