س: السلام عليكم، إذا فُصِل شخص من العمل فصلاً تعسفيًا وتم إنهاء الخدمة بدون إنذار في نفس الوقت، فهل يطلب بدل الفصل التعسفي وبدل الإنذار؟ صاحب العمل برر إنهاء الخدمة بأن العامل يتعامل مع ناس، لم يحددهم، وأساء للسمعة وقد هدد بكسر الرأس إذا تم رفع دعوى. هل يطلب عن هذا الضرر المعنوي تعويضًا من القاضي العمالي مع نفس الطلبات العمالية؛ الأجور والإجازات وغيرها؟ وشكرًا!

Deciding not to rent an apartment after giving a deposit and agency fees
Q: Hi, I recently gave a deposit + agency fee in cash (I have the agency receipt), but we would like to go back on our decision and not rent this apartment. We haven`t signed the leasing contract yet, and neither has the owner. In the receipt, it`s written that the deposit is non-refundable, but I haven`t signed it, only the agent. So I don`t know if it is legal. Do you know if I can get all my cash back (deposit + agency fee) when the deal did not close in the end because of me? Would the reason for deciding not to rent anymore impact the legal aspect of the situation?

How to know the judgment when the portal says "decided"?
Q: Dear sir/madam, There is a case against me in a commercial, full-jurisdiction court. Sorry if I`m getting this wrong. I have not participated in the case and on the advice of my UK lawyers, I have not been represented there in Dubai. Upon checking the portal, it says a judgment was reached yesterday, but I can`t see further details. So my questions are: 1) Do judgments happen behind closed doors or in front of the lawyers? A landlord is not abiding by the RERA calculator and wants to increase the rent
Q: Dear sir/madam, My landlord sent me a notice 95 days before expiring of the contract that my rent has been increased by 40% without any justification. I informed the landlord that we should abide by the RERA calculator and sent him an extract of it where it is clearly stated that no increase in rent for the property. After going back and forth multiple times, I decided to visit RDC. They suggested submitting an offer and deposit which got approved according to the RERA calculator. I sent the certificate to the landlord and he replied back that he rejects this. What should I do next? Can I get Ejari with the offer and deposit certificate? Or do I require a tenancy contract with a signature from the landlord?

Is the property seller liable to pay penalty for not fulfilling the obligations of MoU?
Q: Hello, We have signed an MOU in Dubai to purchase a property. The property is under 3 names (Mother, and her two sons, both minors). The MOU has been signed by the mother 3 times (as co-owner, and then as a legal guardian of her two kids). She then went to court to ask the judge for authorization to proceed with the sale for her kids. Should this have been done prior to signing the MOU? The case has been rejected by the judge since there was no specific clause/condition in the MOU for obtaining approval from the judge. Is the seller, at least the mother, liable for the penalty of not being able to complete the transfer due to her own actions as stipulated in the MOU (10%)? Thanks a lot.
