What losses can I claim in a civil court case?

Can the bank in the UAE initiate legal proceedings in my country for credit card debts?

Q: I left the UAE due to the loss of my job and have credit card payments overdue. However, I found a new job in another country and was in touch with the bank to restructure my credit. Due to the big monthly installments offer from the bank side, we couldn`t reach an agreement. Now the bank is emailing me and threatening to take legal action against me in my current residence country. Can I be sued for credit card debt even if I make arrangements to pay it back?

Q: Dear Sir/Madam, I took out a credit card and did not pay the dues for 3 months. I received a notice to pay. I have now arranged to pay the overdue amount. The card limit is 15,000 and the overdue amount is 3,300. I have arranged to pay 3,300 and then make the full payment of the card before next month`s due date. Will legal action be taken against me even if I pay the overdue amount? Kindly clarify!

تحصيل مستحقات عمالية من شركة مغلقة

س: السلام عليكم ورحمة الله وبركاته، لدي حكم عمالي منذ قرابة العام والشركة مغلقة. قدمت طلبًا للحجز لدى عدد من البنوك والممتلكات، ولكن ليس لدى الشركة أي ممتلكات. كما تقدمت بطلب ضبط وإحضار تم رفضه لأن الشركة ذات مسؤولية محدودة والمدير شخصية منفصلة. كيف يمكن لي تحصيل المبلغ؟ شكرًا لكم!

إمكانية المطالبة بالمستحقات العمالية بناءً على الراتب الفعلي وليس المكتوب في العقد

س: السلام عليكم، أعمل في شركة في العين مند ثلاث سنوات ونصف "منها سنة وعشرة أشهر إقامة تابعة للشركة" وما تبقى كنت أعمل بالإعارة من شركة أخرى. راتبي في عقد العمل 500 درهم ولكن راتبي الفعلي 2500 درهم. هل يحق لي المطالبة قانونًا على حسب الراتب الفعلي؟ وهل فترة العمل بالإعارة تدخل ضمن أيام المستحقات؟ علمًا بأنني أستلم راتبي بشكل مباشر بإيصال قبض من الشركة، وراتب العقد (500) أستلمه بنكيًا أو عبر فروع الأنصاري.

Are the partners of an FZLLC liable for the company debts from their own money?

Q: My company is FZC - Free Zone Limited Liability Company (FZ-LLC). The company is incorporated in the Free Zone with 2 shareholders and has 2 licenses- Commercial & Industrial and has a warehouse for stocking the goods. Every year when the license is renewed, the warehouse rental is also renewed. In the last 4 years, the licenses and warehouse are not renewed and the warehouse is not handed over to the Authorities. The Authorities filed a legal case saying that the warehouse rental needs to be paid for 4 years, and only then the premises can be vacated. Then the judge issued the verdict saying that the owners are liable to pay. Since the owners cannot pay the amount, the judge orders travel bans and arrest warrants for the owners. The company is LLC, which means in general, the owners of an LLC are not personally liable for the debts of the company. This means that if the company is sued, the owners are not responsible for paying off any debts with their personal assets. Am I right?

Mold in apartment due to construction fault: Can I get compensation?

Q: Hi everyone, I rent an apartment. After two days in the apartment, water started leaking from the ceiling. It turned out to be a fault in the building`s construction, which caused condensation in the false ceilings. When the panels were demolished, it was found that they were all full of mold. The building manager has started work, but the apartment is no longer habitable. Should the landlord compensate me for the lack of peaceful enjoyment of the property?
