Q: Dear, I would like to ask about my credit card debts with a bank. My cheque was with the Dubai branch and now they are threatening me to present the cheque in Sharjah. So please, let me know what will be the position. How can I be bailed out? How can it be settled? Thanks

Q: Hi Madam, I have applied to my family visa application yesterday. Today I received a mail from MOL stating that you have to modify the application with the Abu Dhabi tenancy contract. Currently, I`m staying and working in Dubai but my visa is issued from Abu Dhabi. I have submitted my Dubai tenancy contract for family visa application. س: السلام عليكم قدمت طليقتي شكوى تتهمني أنني أرسلت لها رسائل على الواتساب تتضمن سب وتشهير ومس بشرفها (وهذا لم يحدث أبداً وقطعاً)، واستندت في أدلتها على صور سكرين شوت من الحالة الخاصة بي على الواتساب التي فقط أعبر فيها عن حالتي النفسية وليس فيها ذكر آلامها ولا أي تنويه يدل على أنني أقصدها. إلا أنها قدمت هذه الصور على أنها رسائل مني لها وواضح لكل من يراها أنها ليست رسائل لا لها ولا لأي أحد. إنها تقصد من وراء ذلك الحصول على تعويض مالي بعد أن فشلت محاولاتها السابقه أمام القضاء في الحصول على أموال بغير وجه حق، وقد رد القضاة ادعاءاتها. أرجوا إفادتي حول هذا الموضوع رجاءً، وهل الحالة تعتبر رسائل موجهة مباشرة (المقصود الحالة)؟

The penalty of breaking tenancy contract before expiry

Q: Hi, I am a tenant and my agreement ends on 30/8/2019, but due to unavoidable circumstances, I need to terminate the contract early on 30/4/2019. The exit clause states: 1. The penalty for breaking the contract is 2 months` rent 2. The tenant should inform the owner 2 months before vacating the unit otherwise the tenant has to pay 2 months` rent as a penalty. Already given the owner the notice on 10/2/2019, but he is still claiming the 2 months` rent penalty. Please clarify how many penalties are in play here. Thanks Didi

Q: Dear Sir, I am working as a general electrical engineer under an unlimited contract with 3 months notice period. My visa is going to expire on the 04th of March 2019 and I don`t want to renew as I got a good offer from some other company. Do I still need to serve three months or is there any legal way to come out? Also, please confirm how much maximum time my company can hold me without renewing my visa.

Q: Good evening, My husband and I resigned from our company 3 days ago. We are still under probation, with a limited visa here in Ras al Khaimah. But we received a message early morning about a complaint from the labour under our company name, which we didn`t send yet our resignation paper. Compensation for the decreased area of property on delivery

Q: Dear Sir, For my apartment, I had paid for 943 Sqf and at the time of delivery, the developer is giving me space which is 6.16% less. As per the DLD law, the developer has to compensate me but the developer is compensating for only 1.16% and stating that according to Law, the calculation in the decreased area will be based on the area above the 5% only. Resolution of the Executive Council No. (6) of 2010 Approving the Regulation of Law No. (13) of 2008 Concerning Regulating the Initial Real Estate Register in the Emirate of Dubai - Article 13 – paragraphs 3 and 4 states that: “3- The developer shall compensate the purchaser for any change if the net area decreased to more than (5%) of the unit net area. 4- The compensation due to the purchaser will be calculated, if the decrease in the net area exceeding the percentage stipulated in paragraph (3) hereof, on the basis of the value of the real estate unit..." Need your advice. Will the developer compensate for 6.16% or only 1.16%?

إلغاء الاتفاق واسترداد المبالغ المدفوعة لشقة قيد الإنشاء

س: أود الاستفسار عن رسوم مقاضاة مطور عقاري اشتريت منه وحدتين عقاريتين. تم دفع 30% من قيمة العقار + جميع رسوم دائرة الأراضي والأملاك ولكن منذ 7 أشهر يماطل المطور في تسليمي العقد. ولا أعتقد بأن المبالغ المدفوعة تم إيداعها في حساب الضمان. أيضاً، المشروع متأخر والثاني لم يبدأ بعد مع أنه من خلال نموذج الحجز مذكور بأن عمليات الإنشاء بدأت والتسليم في ديسمبر 2019. أريد رفع دعوى لفسخ العقد وإرجاع جميع المبالغ المدفوعة. هل الدعوى مضمونة؟ لا أريد تضييع الوقت في تقديم شكاوى لدائرة الأراضي والأملاك. وأنا من إمارة أخرى وليس لي الوقت للذهاب إلى دبي للشكوى ومراجعتهم. أريد توكيل محامي مختص للانتهاء من الأمر.
