Q: I already completed the 2-year limited contract with my employer. As stipulated in their acknowledgement of my non-renewal, they will release the last salary and gratuity if I will provide any visa or plane ticket. Luckily, I was able to find a new job and while the papers are still in process, I provided them with a copy of visit visa since the new employer cannot provide a working visa unless all legal papers will be done. Even though I already gave them a copy of my visit visa, my old employer is still not giving me my last salary and gratuity. What should I do?

Non-competition clause and dues upon resigning for holding salaries

Q: Dear Nadine, I have recently resigned from my company based in Dubai due to non-payment of my salary for the last three months (Apr/May & Jun 2019). I resigned on 11th June 2019 and served my notice period till 30th June 2019. My company requested to serve 30 days’ notice period which I refused to serve DUE to non-payment of salary. Finally, I requested them to cancel my visa which is under process and soon it will get cancelled hopefully by this weekend. I have also requested them to pay my dues/others which include: 1) Salary for three months 2) 6 years gratuity 3) ALL of 10 days As per my employment contract, an employee may not take up any employment directly or indirectly through a subcontractor with the client of the existing employer for a period of one year after the last day of the service period. Under the above scenario, can I join my ex-employer – client directly or indirectly through a subcontractor? Please advise. Regards, S. H.

Claiming security cheques from client for breach of contract

Q: How can we get our security cheques back given to our client against an advance for an order? Later, the LPO was cancelled after 170 days and we had already started the work for the job. We have offered to give a non-transferable credit note to the client but the client is asking us to deposit an advance given to us against the LPO in the bank account of the client and holding our undated security cheques too. The client has breached the contract by cancelling the LPO after 170 days while a part of the job drawings, structural calculations and other work were done. Please advise how can we get our cheques back.

Claim for the return of money paid to a rental agency

Q: Hi Ma`am, An agency that doesn`t have a license for doing leasing/ property rental business (I came to know this today) has taken my money for providing me 6 months accommodation in a hotel apartment. They did not provide me with the accommodation and after a lot of efforts, I was able to get my partial money back. But the agency is not refunding my remaining amount and they are not opening their office nor responding to my call (they have blocked my number and don`t respond to any new number). Can I file a case in the rental dispute centre and also claim compensation for all the trouble me and my family went through and the expenses incurred? They took AED 2000 cash, a cheque of AED 12500 dated 2nd may (which they used) and another cheque of AED 12500. After the police called them, they returned my 2nd unused cheque and AED 7000 in cash. I have AED 7500 refund pending. Kindly suggest. Thanks, S.
