Q: Good day, If you have an unpaid loan then went to Dubai and got arrested on the airport, what will happen next? If you have a job offer, how long will you be arrested? Please, can someone mention all the details? What will happen since you arrive at the airport until you leave if possible and how much will it cost to pay and continue your life in the UAE?

Forcing the employer to pay labour dues after judgment

Q: I got a judgment from the court for my labour settlement case and I executed another one. After providing so many requests, I didn`t get my settlement. Kindly advise me what the next step is.

استرداد المبلغ المدفوع لمطور بعد مراوغته وإلغاء العقار

س: مرحبًا، اشتريت عقار من مطور ودفعت نسبة 24% من المبلغ في سنة 2015، إضافة إلى حجز عقارين من المطور نفسه. تم إلغاء حجز العقارين وتحويل أموال الحجز إلى العقار الذي دفعت فيه نسبة 24%. تم التعاقد معي على أن يتم تسليم العقار في سنة 2017، وبعدها قاموا بالتمديد لمدة سنة حسب العقد، على أن يتم تسليمه في سنة 2018. تواصلت معي شركة المطوِّر لإخباري أن العقار الذي اشتريته في الوحدة المذكورة في المشروع المحدد تم إلغاؤه. قمت بمراجعة دائرة الأراضي والأملاك ولم يفيدوني بشيء. راجعت شركة المطور ولم يتم إثبات ذلك. راودتني الشكوك ولم أكمل معهم الدفعات المتبقية. فوجئت بإلغاء العقار عن طريق دائرة الأراضي والأملاك رغم تقديمي شكوى عن الموضوع الذي طرحته من قبل بشأن إلغاء الوحدة في المشروع. لم أتمكن من استرجاع أموالي بأي طريقة حيث قام المطور بالانتهاء من العقار بنفس الوقت الذي تم فيه إلغاء العقار من اسمي وتم بيعه لطرف آخر حسب ما ذُكِر لي. يُقدَّر المبلغ المدفوع بمبلغ 700,000 درهم.

Forcing an employee to accept cancellation without any dues

Q: Dear Ms Khan, I signed a job offer on Nov 2017 and worked for 2 years. The labour card & visa expired on 27 Nov 2019. The employer did not renew/cancel/pay salary from Nov. On 5 Jan 2020, I resigned. On 6 Jan 2020, the HR manager acknowledged the receipt of my resignation. I filed a complaint with MOHRE. The employer attended the meeting and accepted my resignation without notice period. He also agreed to verify and settle DUES within 3 days. MOHRE closed my complaint. Now, the employer`s legal counsel is threatening to file a case and contest on grounds of Breach of Contract & Conflict of Interest. They are forcing me to accept cancellation without any dues. My questions are: 1: Are the employer`s actions legal? 2: Can I re-open my MOHRE complaint? If the Employer is not agreeing to MOHRE mediation and goes to court. What is the prescribed time frame to resolve the case? 3: Because my visa and EID have expired, I am not able to travel or even get medical treatment for myself. What are my options? Thanks!

What to do if the visa is expired and a travel ban is imposed

Q: A travel ban is in place and my visa is now expired. This happened because of the non-payment for child maintenance. As I do not have a visa, I am unable to work and, therefore, unable to make payments. What are my options? Would I be arrested because I am an illegal resident without a visa?

The consequences of canceling the sponsoring family member's visa

Q: Dear Madam, Currently, I am residing in the UAE on a sponsorship visa (valid till 26/01/2020) of my husband and working with UAE work permit which is valid till 02/02/2020. Currently, my husband`s visa expired and, due to some internal issues, his visa is not renewed and subsequently, it will affect the renewal of my visa also. So, in this situation, what can I do? Do I need to cancel my visa and go back to the home country until his visa issuance problem is resolved? Would this cancellation affect my work permit?

س: الله يعطيك ألف عافية أستاذ، كنت أنا شريك متضامن بشركة أخي بمقدار 1%. بعد فترة من الزمن، أخي لم يدفع الإيجار لصاحب العمارة وانتقل أخي لمبنى آخر واحتفظ بمفتاح الطابق ولم يعطه لصاحب العمارة لمدة 5 سنوات. رفع صاحب العمارة دعوى يطالب بقيمة الإيجار، وقد أخفى عني أخي أمر عدم دفعه للإيجار. كما قال إن سبب انتقالنا لمبنى آخر هو صغر المكان. حُكِم لصاحب العمارة بالمحكمة بمبلغ قدره 77 ألف دينار مع الفائدة والأتعاب؛ علمًا بأن قيمة الإيجار السنوية 11 الف دينار. استفساراتي: 1) هل يمكن أن أرفع دعوى منع مطالبة مالية؟ علمًا بأن لدي إثباتين؛ الأول: اتفاقية صورية من أخي المفوَّض بأن ليس لدي حقوق من الشركة، والإثبات الثاني: قبل رفع دعوى صاحب العمارة لم أكن أعمل بالشركة لدى أخي، وإنما كنت مجرد شريك وأنا ملتزم بأن الشريك بشركة التضامن ملتزم بأمواله الشخصية ولكن القدر مكتوب. 2) ما الإجراءات في حال طلب الدائن التنفيذ القضائي؟ ماذا أفعل؟ وآسف على الإطالة! كل الشكر والتقدير والاحترام أستاذنا،
