س: السلام عليكم، أرجو الإفادة. أنا متزوج من حوالي 8 سنوات ولدي طفلان من زوجتي وأقيم في ابوظبي. راتبي الشهري 15750 درهم. زوجتي مصممة على دفع راتب شهري تقريبًا ثلث راتبي أو أن أطلقها مع العلم أنني لا أستطيع دفع ذلك نظرًا لأن الراتب لا يبقى منه شيئًا. سابقًا ولعدة سنوات كنت أعطيها ما تريد نظرًا لأنني كنت أحصل في نهاية العام على بعض الحوافز ولكن هذا الأمر توقَّف منذ 3 سنوات تقريبًا وليس لي دخل إلا راتبي الشهري. في حال رغبت في الطلاق نظرًا لكثرة المشاكل بيننا وتطاول زوجتي عليّ بالسب والشتم، أرجو من حضراتكم الإفادة عن نفقة المتعة والعدة مع العلم أن الزوجة لا تعمل. هل هذه النفقة تشمل مصاريف المدرسة مع العلم أنني مَن يتحمل مصاريف التعليم في مدرسة خاصة في أبوظبي وليس لدي مصدر دخل إضافي وأُرسل مبلغًا بسيطًا 1200 درهم تقريبًا شهريًا للنفقة على والدتي. للعلم حدث طلاق مرة قبل أكثر من عام أثناء مشكلة بيننا ثم رددتها، وحاليًا أرغب في الطلاق نظرًا لصعوبة التعامل معها مما يُشكِّل عبئًا نفسيًا على الأطفال. جزاكم الله خيرًا!

Q: Respected Sir, I have a court case in Al ain court against my employer. Now I have received another offer from another employer. Can I get any letter from the court for my labour card cancellation without the NOC from the current employer? If yes, I kindly request your expert guidance.

س: السلام عليكم، أنا قيّم على أخي المعاق ذهنيًا. ادّخرت له بعض المال من معاشه على مدار سنين وأريد أن اشتري له شقه باسمه. سؤالي هنا: ١- إذا اشتريت شقه باسمه وارتأيت مستقبلاً إيجارها لصالحه أو بيعها لأي سبب، فهل البيع والشراء بموجب قرار القوامة فقط أم يلزم إذن من المحكمة؟ ٢- إذا كان إذن المحكمة واجبًا في عملية البيع والشراء، فهل إذا اشتريت الشقة باسمي ثم كتبت عقد بيع ابتدائي مني لأخي واستصدرت عليه صحة توقيع، هل يكون سندًا قويًا له لحفظ حقه في حال توفاني الله؟ شكرًا جزيلاً!

Reducing the rent for a few months due to COVID-19 salary reduction

Q: Good Morning, Due to the global pandemic, Hotels and Tourism business is majorly effected and that resulted in my 50% salary reduction for the month of March, April 2020. I am not sure if I might get paid these coming months as well. My wife is a Cabin Crew and is effected with the same salary reduction scenario and due to no flights assigned is getting paid only 20% of the actual she was earning before the Covid-19 outbreak. I politely requested my landlord to either decrease rent for the month my salary will be effected or extend the tenancy contract free of charge for a few months, that will ease my financial burden for the Year 2020. Please guide me through this financial crisis & rental relief situation. Thank you

س: السلام عليكم ورحمة الله وبركاته، سؤال: فيما يتعلق بقانون الخدمة الوطنية وتعديلاته في دولة الإمارات، هل يحق للجهة المختصة أن تحجز جواز الشخص المتخلف عن الانضمام للخدمة الوطنية، وتمنعه من تجديد جواز السفر وتجديد الهوية الإماراتية إذا انتهت صلاحيتها، حتى لو كان التجديد عن طريق التطبيقات الذكية؟ وما المادة القانونية التي تفيد بأن يحق للجهة المختصة أن تمنع الشخص الذي لم ينضم للخدمة الوطنية أن يجدد الوثائق والمستندات الثبوتية؟ وبذلك لا يستطيع أن يتعالج طبيًا؟ يُرجى التكرُّم بإفادتنا قانونيًا!

Responsibility of the employer for expenses of employees in pandemic

Q: I am working in a company which is registered in Creative City Fujairah Freezone. Last month, our employer sends us on unpaid leave from April to September. He said he will provide tickets to return back to my country but suddenly the lockdown was imposed. I didn`t sign any extra document and this discussion happened on Whatsapp. On May, I asked for the accommodation cost but he said he won`t pay anything, not even for the food and for the rent which I have to pay. I am now helpless, I don`t have money to survive here. Isn`t he responsible for the rent and food cost until I leave the UAE? Please guide.

Cancelling the visa of an employee who filed a false complaint

Q: I needed some information in regards to visa cancellation. One of our employees filed a false complaint with DDA (Dubai Development Authority) to stall the visa cancellation. He is not on our payroll since July 2019 and we are not able to cancel his visa because of his dependents. We have filed for absconding with MoL and is still pending as there is this an ongoing dispute. Can we file a case against the employee for defamation? He is trying to mislead the authorities and extort us.

Action against posting fake and defamatory content on social media

Q: A Facebook page has posted fake content against me. Personal details (employment, name, picture) have been posted online along with derogatory comments. The post is being shared under false pretences wherein it appears that I have posted comments against other religions. I would like to confirm that I haven`t posted this content and you may check the same in your records. I would also like to bring to your notice that the admin of the page is also encouraging the general public to report my profile to relevant authorities. The post has been posted on twitter, shared over 700 times on Facebook and I am continuously receiving abusive messages. A police complaint has been made. Please advise on how to proceed.

Acting against the employer for unjustified COVID-19 salary cut

Q: My company is in the business of Personal Protective Equipment (PPE) and we do sell protective garments for COVID-19. Due to COVID-19 opportunity, our company is doing fantastic business. We not only finished our Year 2020 budget but exceeded by 40%. We have 7 more months to go. However, my company came up with this lame excuse of "Corona Situation" and forcing to accept a 25% reduction in salary and other compensations/ commissions. As you see we are not at all affected by Corona but doing fantastic with this COVID-19 situation. Please guide how I can protect my rights and which authority can help me/ I should approach. Q: Hi, I am planning to divorce my wife we are married for 4 years with a 3-year-old daughter. I just want to know to whom custody of the kid will go after the divorce. Rights of the employee after termination for taking a sick leave

Q: My company terminated me based on articles 82,83,84 & 85 after I got a stroke in November 2019 when I was on duty and the company took me to hospital. My GM also visited me home saying that no need to submit sick leave as it will cost you every time. Once you`re fine come to work. They forcefully took signature on annual leave after one month of my sickness. I was paralyzed from one side and was not in a condition to travel, still, the company issued me a ticket part of the annual leave. Now, they have terminated me and did not pay the salary to me since January 2020 nor are they paying my physiotherapy bills. They didn`t even give me any notice period before termination. Please advise what can I do. I have even filed a labour complaint but it`s of no use. I am a driver by profession. Please contact me. Thank you

Cancellation of an off-plan property contract due to delivery delay

Q: Seeking cancellation for the delaying property delivery, as developers are not being reasonable. I purchased an off-plan property in Dubai which was due for handover in June 2018 but still incomplete as of May 2020 (approx. 58%). 80% has been paid from a purchase price of 1.97 million, plus 4% DLD fees. After pleading with developers for assistance, I recently got offered 2 x 999,999 AED, properties from the Developer (not ready till first quarter 2021 apparently), plus DLD fees as they would be classed as new sales. I wish to cancel the purchase. Do I get additional rights for a 2-year delay and being under 60% completion? Can I use force majeure (I`m on 75% wage reduction till September due to COVID-19)? Has a law come into play to have additional compensation whilst renting during the delay? (I was advised on June 2019 by the SLC that there were discussions at DLD but nothing official). Can you claim the 4% DLD fees back? Thanks in advance
