Keeping custody of daughter due to the non-payment of maintenance

Q: Assalamu Alaykum. Please advise me. My daughter turned 13 and I know my custody already ended. Her father did not support her financially for the last 8 years. He rejected all of the help I asked. Can he file for the custody of my daughter in Dubai Court? Is there any time frame for him to file? Will the court give my daughter to him? Thank you!

Claiming compensation for an accident in a large mall in Dubai

Q: I am looking for advice on serving a legal notice to one of the large malls in Dubai after I had an accident and fractured my ankle in 2 places. I am considering purchasing a Fixed Fee service from you - Drafting and Serving a legal notice to the mall management in regards to compensation. I would like to know what would your professional fees be if I required your expertise beyond this fixed fee service? I have been advised by a UK lawyer that because I am a western female, I will receive less compensation if negligence is proven, is this correct? I am a professional businesswoman and this accident has caused me much pain, distress, and affected my ability to manage my business, so I would like some compensation for my losses. Also if negligence can`t be proven, I understand that the UAE has a no-fault compensation scheme so that I would receive compensation for injuries if no one is at fault, is this correct? Inability to renew the tenancy contract and extending it for one month only

Q: Hello, Our contract for our villa expires this Thursday, 30th April. Due to the coronavirus lockdown, we had not been able to leave our home to view other villas until the lockdown got lifted on Friday, 24th April. This gives us only a week to view properties and move. We asked our landlord for up to a few more weeks here to give us a bit more time. In the meantime, I will let people see the villa and show them around whilst he also tries to find new tenants. He declined and said that we can stay for another month if we pay the same rent pro-rata for a month. We explained that we cannot afford that; it is the reason why we are moving to find a cheaper place. We offered 15,000 instead of 25,000 for one extra month and I will be happy for people to view whilst we are in it, but he also declined that offer. He has not shown any consideration for us, we find it difficult to move over the lockdown. What is our position if we stay a few weeks beyond our contract expiry date?

Claiming passport from public prosecution after closing case

Q: I am a visitor to Dubai. I have an extradition case. I have signed a paper with the Dubai police that I will be on my own to go to Peru to resolve my issues with the authority there. I am on bail from 03 to 18 March and my case is already closed at the public prosecution. I wanted to know what`s the procedure and how long it will take for me to get the clearance from Abu Dhabi for me to receive my passport and bail money back and leave allow to Dubai. I have applied to the public prosecutor to get my passport and bail money back but it has been rejected.

Is it legal to give a post dated cheque against the final settlement?

Q: I should have my final settlement on May 9 as my last day of work will be May 2nd. The company offered me to pay me in 2 payments. A bank transfer was made in the 1st week of May and the second 50% in the 1st week of June by giving me a post-dated cheque. The issue is I didn`t plan to stay 1 more month as I should leave the country. 1- Is this legal to offer this kind of payment? What can I do? 2- If I have to stay, they have to pay my expenses (rent and bills) to stay one more month in the country?

Q: Hi, When a case gets transferred from MoHRE to Dubai Courts for non-payment of FNF by an employer (accumulation of salaries), what happens there at the court in terms of process, proceedings, charges, cost of hiring a lawyer...etc? In my case, I worked with a company and left them in April 2019; I have not received my dues till date. Have followed up multiple times; got a case raised as well but they still didn’t clear the amount. It’s been a year almost and I`m very stressed out because of this. Please advise, what can I do?
