A judgment is wrongly being executed against a company with similar name

Q: There are two companies with similar names. There was a civil case filed against one company but the judgment is being executed against the other one due to a mix-up with the name.

The employer is not providing release papers on the expiry of limited contract

Q: Sir, I am M. S. holding a limited contract - engineer visa, and working in a private company. My labor contract will expire on September 24. I got a better opportunity with twice of salary which I am getting previously. I sent the non-renewal letter on 19 August 2021, with 30 days notice period. I need to join the new company on or before Sept 19. The new company can hold the offer maximum till September 2021. My company is not willing to give the release within 30 days. They will delay the release and this will lead to losing my job offer. Can I join the company after completing 30 days? Kindly advise. Regards, M. S.

Q: Hello, I had recently signed a sale contract of my property through a broker in Dubai. The broker was supposed to have the deposit 10% cheques. When I had asked for a copy of the deposit cheques, I realized it was from a third party. Doing a background check of the third party company, I discovered that the third-party company had an expired trade license (they provided valid dates on trade license, meaning government trade license document was forged) and now the sales agreement dates are coming to an end; I don`t have managers cheques nor valid deposit cheques. The only documents I have are deposit cheques from a third party, letter of assurance from the third party company (with forged copy-pasted signature and no stamp, forged trade license of the third-party company). What can I do?

Is WhatsApp an eligible medium for sending a notice to a tenant?

Q: I have notified my tenant of the rent increase 90 days in advance of the expiry date of the tenancy contract via a WhatsApp message. I understand that WhatsApp is an eligible medium for the said notice, as per the Electronic Communications and Transactions Act, 2002 No. 25 of 2002. Refund of the amount paid to an immigration agency for breaching the agreement terms

Q: We have signed an agreement in October 2020 as a “UK Start-Up visa” with immigration advisers in the UAE. According to the agreement, we have paid AED 25000/- as a full package to get the visa. After submitting the application and following up for the last 6 or 7 months, they are now disclosing and asking for endorsement fees of 50,000/- GDP, which need to pay endorsement bodies for 2 years. Earlier, they did not inform us nor mentioned it in any article of this agreement, which shows it was hidden from us at the time of signing the agreement. Due to this reason, we do not want to continue and the advisers do not agree to refund our money AED 25,000. Request for your assistance and help

Seeking compensation because of an accident in a hotel

Q: I had an accident in a hotel in Dubai. When I tried to go out, my face got hit by the glass door. My nose got hurt with bleeding and cut over it. I don`t know if I can do something against the hotel since there was nothing on the glass; like a sticker that tells it is locked. It is very dangerous! Also, the staff told me that it is not the first time it happens.

س: السلام عليكم، الرجاء المساعدة لرفع قضية عمالية! عملت في جروب لمجموعة من الشركات لمدة ٧ سنوات ونُقلت للعمل في شركة لمدة سنتين، ثم نُقلت بعدها لشركة أخرى في المجموعة لمدة سنتين ومن ثم نُقلت للشركة الأخيرة وعملت فيها لمدة ٣ سنوات وتُسدَّد مستحقاتي عند نقلي من شركة لشركة أخرى، مع العلم أن جميع الشركات لنفس المالك. هل لي الحق في المطالبة بالإجازات ونهاية الخدمة لدى جميع الشركات أم لدى آخر شركة عملت بها؟ عندي رواتب متأخرة لأكثر من ٦ أشهر. كيف يمكنني معرفة الرواتب المتأخرة لأن الشركة تدفع جزء من الراتب وليس كامل الراتب؟ عند الدخول إلى حماية الأجور، لم أجد الرواتب إلا لمدة ٦ أشهر مع العلم أنه لدي رواتب وأجزاء رواتب منذ عام ٢٠٢٠. ولكم جزيل الشكر!

How to get married while the Wali is not present in the UAE?

Q: Assalamu alaikum, I want to get married in the UAE. We both are Muslims. I am from India but live in Canada and the bride is from Morocco. The bride`s father cannot be physically present in the UAE to attend the wedding, I read that he can do a proxy to appoint another Wali of the same religion, can this person be anyone? And also I have read that if the girl is of good mental health, she can choose not to have a Wali, can this be done in the UAE?
