Does the gift stand as a sale in its legal effects for a property transfer?
Q: Dear Sir, I served a 12-month notice to my tenant in Dubai to vacate my apartment through the Court (Notary Pubic) in March 2022 because I wanted to sell the apartment. I have not been able to sell the apartment because I did not get any suitable offers to date. Now my son has offered to buy the apartment from me, so I would like to transfer the title deed to him by way of a `gift` because it is more cost-effective. Will the gift of the apartment to my son count as a sale without any restrictions? I am not a resident of Dubai. As per my understanding, the gift will count as a sale, because the ownership will change and a new Title Deed will be issued in my son`s name by the Dubai Land Department. I would like to get this opinion in writing for my records.

Is it legal for the landlord to ask for a rent higher than the RERA index?
Q: I am a tenant and for the last 3 years, my landlord has been arguing about the rent. I always say I will pay as per RERA. Last year in Jan 2022, he gave a court-attested notice to sell. All year he has been threatening to throw me out and not to renew if I don`t agree to his demands of an 80% rent increase. He has only done 1 viewing in the last 12 months (the property is not listed on any website). He is willing to let me stay if I accept an 80% increase in rent, otherwise, he is asking me to leave (refuses to give this offer in writing). He is saying he has enough evidence to show he tried to sell and after I leave he will keep empty for 2 months and then rent it out. I have emails from past years. During this year, I have had some WhatsApp messages but he is refusing to give the actual renewal offer in writing. If he gives me a drafted Ejari physically & gets my signature first before signing himself, will I still be able to take it as evidence to RDC? Or will the RDC say I have agreed to the new terms by signing the new Ejari?

Q: Hello, I am in the UAE. I got divorced 2 months ago. I still live in the house of my ex-husband with my daughter who I got custody of. He owes me money. The court ordered him to pay and the execution was approved. I pay the school expenses of my daughter as he was not paying. I spent 35000 for that as well as expenses for this year`s school. I don’t have money to move out and rent a place since he is not paying me anything. He moved his new wife in and is threatening and harassing me to get out. Because I have no home and he has, he claims that he will keep my daughter and kick me out. What should I do?

Q: Hi all, One of my friends has a pending credit card debt in the UAE/Dubai. She left the country around 5-6 years ago. She was contacted by an agency, approximately 1-2 years after she left, and was told that she has to make payments or else face a travel ban, a police case, etc. She asked for the details of the transactions from the agency and bank so that she could settle the payments from outside the UAE, but the bank or agency did not provide detailed statements after repeated requests. Now, after almost 4 years, my friend`s family members, such as parents, cousins, and brothers, want to go on a holiday to Dubai. Will they be prevented from entering Dubai and stopped at immigration if they have the same family name or address on their travel documents? Can someone please advise, as my friend is quite worried? Q: Dear sir/madam, I renewed my tenancy contract with my landlord 2 weeks ago (this is the 1st renewal, i.e I have stayed here for 1 month, and now renewed 2 weeks ago).
