Claiming maintenance from husband living in Dubai

Q: Dear Sirs I married (Nikah) my husband, Egyptian national working in Dubai, on 17/03/2018. I was due to move to Dubai, and I translated all my official documents into Arabic, had them notarized...etc. because my husband promised to pay me. I have evidence of this promise in WhatsApp. This amounted to something like 15´000 SEK (Swedish krona), which is not a lot of money. Also, he has not paid my Mehr of merely 1000 SEK. Q. التوقيع على أوراق التسوية دون الحصول على المستحقات

س: مرحبًا! قامت الشركة التي عملت بها لمدة ثلاث سنوات بإنهاء خدماتي عبر إرسال إخطار لمدة شهر. عثرت على عمل آخر خلال هذه المدة، و بعد انتهاء فترة الإخطار، لم تقم الشركة بدفع مكافأة نهاية الخدمة ولا المرتبات المُعلَّقة وطُلب مني التوقيع على ورقة تسوية للبدء بإجراءات نقل الإقامة إلى الشركة الجديدة. وقَّعت مُرغمًا على الورقة بدون الحصول على المستحقات خشية أن أخسر وظيفتي في الشركة الجديدة؛ لأنه لا يمكنني مباشرة العمل دون البدء بإجراءات نقل الإقامة. مضى شهر على مباشرتي للعمل في الشركة الجديدة وإلى الآن لم أحصل على مستحقاتي من الشركة السابقة بحجة عدم توفُّر الأموال. من ناحية أخرى، ما زلت أستخدم سكن الشركة السابقة لعدم قدرتي المادية على الانتقال إلى مسكن مستقل قبل الحصول على مستحقاتي. أولاً: هل يحق للشركة السابقة اقتطاع أجرة المسكن من المستحقات التي ما زالت بحوزتهم عن الفترة التي تلت انتهاء مدة الإخطار؟ فأنا ما زلت إلى الآن أستخدم سكنها للسبب الذي ذكرته سابقًا. ثانيًا: ماذا أفعل للحصول على مستحقاتي؟

Possibility to hold renewing a labour contract for a few months

Q: Hi, I am on my father`s visa. My labour contract in a private company is getting expired in April. I want to apply for 6 months long leave and planning to rejoin by August. Will there be any issue if I leave early without renewing my labour contract which is due in April? Will the expense incurred by the company to renew my labour contract in April (which is not possible since I would be on leave) and the expense to reapply for another labour card when I return from leave in August be the same? Please note that I am not on the company`s visa.

حجب البنك لمستحقات نهاية الخدمة الخاصة بعميل دون إخطاره بسبب ترك وظيفته

س: السلام عليكم، تركت وظيفتي في فبراير 2019 وانضممت إلى شركة جديدة في نفس الشهر. كان لدي، في ذلك الوقت، قرض من بنك لسيارتي بدين مستحق يبلغ حوالي 15000 درهم. أبلغ عملي القديم البنك بأنني تركتهم. وعلى ذلك قرر البنك، دون إخطاري، حجب كامل مبلغ استحقاقات نهاية الخدمة عن وظيفتي القديمة على الرغم من: 1) دفع جميع دفعات القرض عن السنوات الأربع الأخيرة بالكامل وفي الوقت المحدد للدفع. 2) إيداع راتب وظيفتي الجديدة في حسابي مع البنك. بعد التحدُّث مع البنك وتقديم شكوى لديهم، فكوا جزءًا من المبلغ ولكن حجبوا 10000 درهم. وهم ينقصون المبلغ المحجوب شهريًا. واليوم لا يزالون يحتجزون 5000 درهم. لا تنص مستندات القرض التي وقعتها على أن البنك له الحق في حجب أي مبالغ في حالة فقد أو تغيير وظيفتي، ومع ذلك، أبلغني موظفو البنك بأنها "سياسة البنك" (Bank Policy). ورفضوا مشاركة هذه السياسة معي. هل يمكنني الإبلاغ عن البنك لخيانته للأمانة؟ حيث أنني أودعت راتبي وأموالي لدى البنك والبنك اعتدى عليها بدون حق.

س: أعمل لدى شركة في الإمارات. بعد أن أُجري تعديل وضع وتصريح عمل وتوقيع عرض عمل، أكملت شهر ونصف وقدمت استقالتي رسميًا لصاحب العمل قبل فحص الدم و إجراءات الهوية، إلخ. صاحب العمل لم يلغِ تأشيرة العمل، بل سمح لي في الفترة المتبقية من الـ ٦٠ يومًا بالبحث عن عمل آخر، وحين أجد عمل، سيتخذ اللازم لتحويل الإقامة. الأسئلة: ١. هل يلزمني شهر إنذار إضافي كما هو موضَّح في عرض العمل؟! علمًا بأن الفيزا مدتها ٦٠ يومًا فقط مضى منها شهر ونصف عمل ولم أوقِّع على العقد الرسمي. ٢. كم عدد أيام السماح بعد إلغاء فيزا العمل (٦٠ يومًا) لتعديل وضعي بعمل زيارة جديدة ؟ ٣. هل سينطبق عليّ قانون الحظر التلقائي لمدة سنة و لم أوقِّع على العقد الرسمي بعد؟! وشكرًا!

Terminating a tenancy contract by a tenant because of smoking neighbors

Q: Hi, I have spent just 1 month here in my new apartment with my wife and my 6 months old baby. Our neighbor is smoking inside their flat and the smoke comes inside our flat. We have already complained about it to the management and the management keeps only warning them. I have a baby who is at risk for smelling cigarette smoke and we`ve found out that the tenant has many complaints already. The management seems very soft to them. Are we allowed to break our tenancy since the management fails to control them? I think they have a friend who is a senior manager of the building and that`s why they keep on doing crazy things without eviction. Can we terminate our contract for this reason since we have a baby?

التصرُّف السليم عند إخلال المطور العقاري بالتزاماته

س: اشتريت وحدة سكنية من مطور عقاري في دبي عام 2015 وكنت منتظم في سداد خطة الدفع ودفعت إلى الآن 81% من قيمة الوحدة، وكان موعد التسليم في يوليو 2018 وفترة السماح 12 شهرًا حتى يوليو 2019. لكن حتى الآن، نسبة اكتمال المشروع هي 76% فقط وقام المطور بتمديد تاريخ نهاية المشروع عدة مرات وآخرها إلى سبتمبر 2020. بناءً على العقد، فبعد فترة السماح، هناك غرامة لا تزيد عن 4% من المبلغ المدفوع عن كل سنة بعد فترة السماح. تواصلت مع المطور وأبلغني بأن المقاول تأخر في المشروع. نصحوني أن أقوم بالترقية إلى وحدة جاهزة وأكبر ومفروشة ودفع الفرق بين الوحدتين. وطلبوا مني حجز الوحدة الجديدة المختارة بمبلغ 20000 ريال، وفي حال لي يعجبني السعر من لجنة الإدارة بعد خفض سعرها، فسوف يضاف المبلغ (20000) إلى حساب الوحدة السابقة التي لم تنتهِ بعد. لكن طلبوا أمر لم أوافق عليه حتى الآن؛ وهو بحكم أنني اشتريت الوحدة عام 2015 بسعر عالي وسعرها الآن خسر 200 ألف تقريبًا، فسوف تضاف 200 ألف على سعر الوحدة الجديدة. ومضى على هذا التواصل 20 يومًا تقريبًا ولم أجد إجابة منهم بخصوص الوحدة الجديدة أو مبلغ 20000. هل هذا العمل قانوني أم لا؟ وكيف أحصل على حقي من المطور العقاري؟ شاكر نصحكم!

Acting against the threats of husband after abandoning family

Q: I am here in India and my husband works in Dubai. He has abandoned me and my children. He is calling me up now and threatening me of committing suicide, and also he wrote a suicide letter which mentions my name on it so that I get caught.
