س: زوج تكفَّل بسداد مبلغ قرض عقاري لزوجته الأولى لدى بنكين كونها لا تعمل؛ الأول قيمة قسطه 16660 درهم والثاني قيمة قسطه 4290 درهم، ومن ثَم رفعت عليه قضية نفقة زوجية ونفقة ستة أبناء وتم الحكم بمبلغ 22000 درهم. قامت الزوجة الثانية وهي مطلقة برفع قضية نفقة وتم الحكم بنفقة شهرية بقيمة 2500 درهم شهريًا. مجموع المطلوب شهريًا 45450 درهم مع العلم أن راتب الزوج 32900 شهريًا، والزوج لا يملك أي شيء سوى راتبه. أسئلتي الآن: 1. هل تستطيع البنوك بيع منزل الزوجة لسداد المبالغ المستحقة لقيمة القروض المستحقة مع العلم أن الزوجة لا تملك هي الأخرى سوى هذا البيت بالإضافة إلى أنها لا تعمل؟ 2. هل يستطيع الزوج تقديم طلب إثبات حالة إعسار كون التزاماته تجاوزت دخله الشهري؟ 3. هل يعفي إثبات الإعسار الزوج من التزاماته المالية لدى البنوك كونه كفيلاً لزوجته وليس المالك الأصلي للعقار؟ 4. ما النصيحة التي تنصح بها الزوج؟ وشكرًا!

Q: Hii With due respect, I want to ask a question I am working in a company as an HSE representative. There was an incident that occurred with a workshop in charge and he got fractured on hand. He got all the treatment and he is ok now. When he got injured, there was a case filed and he got a medical test twice from the forensic team of the police. But the police say that I can not travel (a travel ban) until the case is finished by public prosecution court. Can you please tell me how can I get rid of this case?

س: السلام عليكم، طلب مشورة من ذوي الاختصاص. لديّ شقة في مشروع عقاري، وحسب العقد المبرم أدفع ٤٥٪؜ من قيمة الشقة في أثناء البناء على تواريخ متفق عليها من قبل الطرفين و٥٥٪؜ عند الاستلام. ذُكر في العقد موعد الاستلام في شهر ١٢ من سنة ٢٠١٩، ولكنني دفعت ٢٥٪؜ فقط وأوقفت الدفع التالية في بداية ٢٠١٩ لأن المشروع كان متوقفًا تمامًا وبعدها جرت عدة اتصالات مع الشركة المذكورة حول سبب وقف العمل بالمشروع لأني لست مقيمًا في دبي والآن يطالبونني بسداد الأقساط المتفق عليها بقيمة (٢٠٪) مع غرامة لأنني أوقفت الأقساط بمبلغ ١٢٠ ألف درهم إماراتي. اتصلت بهم وبعثت عدة إيميلات ليحذفوا الغرامة وكان الجواب بالرفض بحجة التأخُّر في السداد. إذا كنت متأخرًا في السداد، فهم أيضًا متأخرون في تسليم المشروع وهو ما برروه بأن لديهم عذر في ذلك. طلبت منهم أيضًا دفع ٣٠٪؜ لغاية التسليم وبعد التسليم ٧٠٪؜ وأيضًا رفضوا. حاليًا ليس لديّ ثقة في هذا المطوِّر لأن تعاملهم ليس سلسًا مع العملاء. هل هناك طريقة لفسخ العقد واسترجاع أموالي التي دُفِعت لهم؟ أو، أضعف الإيمان، هل هناك تعويض بسبب تأخرهم؟ مع خالص شكري واحترامي!

Q: I just found out I have a rental case in Sharjah. In the flat where I stayed, I had canceled the water and electricity and got a clearance certificate but did not complete the closing process with the landlord. They automatically renewed the contract as per the old agreement and went legal. There is a judgment also from Sharjah court to pay 1-year rent of 28k and evacuate. 1. There are no pending cheques. Is this a criminal case or a civil case? 2. Will I have any issue when I land in Dubai on a visit visa?

Q: Is there any legal action I can take against a person for spreading false hearsay stories publicly which are false and not even linked to his company & he never checks with me on the true facts? The background story: I have legal negotiations and proceedings going on with a company that signed a business deal (between companies) with my company registered outside the UAE. While all this is ongoing legally, I get to know that the employee of this company with whom I am legally negotiating the disputed contract separately has gone and spoken to my ex-employer`s CEO (as they are good friends) and they have started telling rumors and wrong facts in the market making everyone think that "I ran away with the money".
