الزوج لم يوفر سكن ولا نفقة منذ سنتين. ماذا تفعل؟

س: السلام عليكم، تزوجت منذ ثلاث سنوات وعندي بنت عمرها سنتين وسبعة أشهر. الزوج لم يوفر سكن ولا نفقة لي ولا حقوقي الزوجية منذ سنتين. أريد أن أطالب بحقوقي وحقوق ابنتي الصغيرة.

Asking a tenant to pay more rent and threatening to disconnect the DEWA

Q: Dear sir/madam, I signed a contract F with a seller to buy his house. I asked the seller to move into the house prior to signing the transfer document, and he agreed under the condition that I pay him a rent until the date our bank clears his mortgage. After moving into the house and once his loan was cleared, he sent me an email and asked for more rent and threatened me to cut the DEWA. The transfer should happen next week, what is my legal position? As per the contract, he is obliged to come to the signature. I told him that if he disconnects the DEWA and asks me to leave the house, then he is breaching our initial rent agreement, based on which I moved to the house. Can he know use this in court by not coming to the transfer date appointment, saying that I didn`t pay him rent? I confirmed many times that I will still pay the rent we agreed on in the first place unless he cuts the DEWA or ask me to leave. Please advise!

The inheritance of a bank account

Q: Hi! I would like to know about the inheritance of a bank account. Who receives the money? And can we make a will to ensure only the wife and children receive money as it is a movable asset or normal sharia law will apply?

تخفيض النفقة بسبب ترك العمل واستعادة جوازات الأبناء

س: السلام عليكم، طلقت زوجتي في فترة كورونا وكنت خارج الدولة ورجعت بعد غياب سنتين بسبب الظروف وكانت المحكمة قد حكمت بإبقاء جوازات سفر الأبناء مع الأم ونقل إقاماتهم عليها. رجعت للدولة ودفعت كامل النفقة المقررة للسنوات السابقة. لدي سؤالين من فضلكم: 1. لا أعمل حاليًا وأبحث عن عمل، فهل أستطيع أن أطلب من القاضي تخفيض النفقة بسبب عدم العمل وأنني أبحث عن عمل؟ 2. عند حصولي على عمل وعمل إقامة لي، هل أستطيع رفع قضية للمطالبة بإعادة إقامات الأبناء عليّ أنا الولي الأب وإبقاء جوازات سفرهم عندي بحكم أنني الولي عليهم، ولا مانع لدي من تسليم الأم الجوازات في حالة الطلب؟ هل ممكن أن أرفع قضية بهذا الخصوص للإقامات والجوازات لإعادتهم لي بحكم أنني مقيم في الدولة ولدي دخل ونفقة وأنا ملتزم بها؟ وهل سيوافق القاضي بحكم أن الولي مقيم في الدولة ويجب أن تكون الجوازات والإقامات عليه؟ وشكرًا لكم!

The landlord refuses to fix any major issues in the property. What to do?

Q: Dear sir/madam, I am terminating my tenancy contract with my landlord. He gave me an eviction notice in May and since then he has refused to fix any major issues in the property saying that "I`m free to fix it at my own expense", forcing me out of the property. Given these conditions, am I on the obligation to pay the 2 months` penalty for early termination? It seems to me that he waited until the contract was renewed to give me an eviction and force me out.

A tenant did not receive the email of rent increase. What to do?

Q: Hi, My landlord, through his agent, sent an email for a rent increase 86 days before my lease expires. The mail, unfortunately, went to the spam folder & was deleted before I could reply to it. I reached out to renew the contract. The landlord is insisting I renew at the rent mentioned in the mail as there was no response earlier and has even threatened eviction. Can I challenge this? Or can my lack of response to the earlier communication be taken as being an agreement to the new rent?

Q: Dear sir/madam, I am working as a sales staff for footwear leather products in Dubai for more than 3 years. I submitted my resignation letter last July 31, 2022, and my last day will be on August 31, 2022. Non-renewal of a tenancy contract after confirming its renewal

Q: Dear sir/madam, I have confirmed to renew my apartment tenancy contract with my apartment`s management team three months before the expiration date (as per the contract) via email, after which no renewal contract was signed. Now, one and a half months before the expiration date, can I decide not to renew the contract without any penalty? Is the written confirmation via email previously taken as legal in Dubai?

إعادة تقديم المطالبات من قبل العامل لدى استئناف صاحب العمل للحكم

س: السلام عليكم، لدي قضية عمالي جزئي وتم الحكم فيها بمبلغ أكثر من 50 ألف بقليل بالرواتب المتبقية ومستحقات نهاية الخدمة وبدل شهر الإنذار وراتب الإجازة، والمحكمة لم تحكم لي في الفصل التعسفي لعدم وجود نتائج وآثار على المُدعي. دخلت في مهلة الاستئناف وقبل انتهاء المدة بثلاثة أيام، استأنفت الشركة على الحكم الصادر وقدمت مستندات أغلبها تؤكد الحكم، ولكن تم تقديم الاستئناف لتطويل مدة الدعوى. هل أستطيع إعادة المطالبة بالفصل التعسفي 3 أشهر وبدل عن غرامات تأخير الإقامة وتعويض شهرين مدة القضية؟ ولأنني لا أملك المال لتوكيل محامي فقد كتبت مذكرة على مذكرة الاستئناف، ولكن لا أعرف الصيغة القانونية لتفاصيل الوقائع والرد والجواب. شكرًا مسبقًا واعذرني على الإطالة!
