Q: I was offered and interviewed for a job in online marketing in a mainland company on a limited contract basis on a Store Keeper visa. After a couple of months, they want me to do helper and cleaner work as there are no ongoing online sales and I never got paid a salary on time. Every time I need to beg for my salary in the middle of the month! I now would like to know what are the legal consequences I will face if I break the limited contract (in my contract it was mentioned in Article 7) as it is taking a toll on my mental health. Could you elaborate on this, please?

Is the commision paid to employees included in the VAT system?

Q: I work for a UAE-based broker, and we earn commission from our agents (employees) introducing and recommending clients to a provider. Once the client transacts with the provider, we (the company) get paid a commission. I understand that commission received by the company is subject to VAT due to the service provided. Our employees are paid both a salary and commission, and commission payments are directly related to the clients they (the employees) have introduced to the provider. Should we be applying input VAT to the commission paid to agents? It is considered a sales expenses and considered an operating expense on the income statement. I appreciate any help you can provide.

What is the start of the contract date that MOHRE take into consideration?

Q: Good morning, The company made me redundant one day before completing the 6 months probation period. As per the contract of MOHRE, the start date is 18 Oct but they asked me to sign a letter late that the start date changed to the 27th of Oct and I had to sign the letter. The letter is not even signed by some IT guy in the office. I feel they knew what they are doing hence the new letter to change the new start date. Can I complain about that? Is the letter recognized by MoHRE or the date on the contract is the one? Thank you

Q: I`m A. M. s/o M. H., my father was in the UAE Airforce, and on 2 August 2021, he didn`t come back to his flat. We are living in Pakistan and on asking his flatmate and colleague about his whereabouts, we found that he is flying. After three days of going missing, he called us and told us that he is under some investigation because of some confusion and it will be over in a few days but till now it`s not over and we do not know about his case and where he is. Q: Hello, I am looking for legal advice regarding the following case: I ordered from a clothing manufacturer several custom-made items (T-shirts, sweaters, etc.). While customizing the items before production, I was offered different fabrics and ended up choosing one which was presented to me as 100% cotton. The items were made and the manufacturer put labels on each and every piece indicating they are 100% cotton. Recently, someone brought to my attention that these fabrics were not 100% cotton. I asked the manufacturer to provide a certificate saying that they are and he refused, coming up with some excuses. So I paid for a test myself and the results showed that indeed these fabrics are not 100% cotton. This puts me in a very bad position as I plan to sell these items, which I can`t do now as I will be lying to my clients. What can/should I do now? Can I ask for a full refund? فسخ العقد بسبب نقص مساحة العقار الفعلية عن المساحة المحددة في العقد

س: السلام عليكم، اشتريت عدد من الوحدات العقارية في سنة 2006 وقد تأخّر إنجاز المشروع حتى 2018. سجلت دعوى لفسخ العقود وصدر الحكم الابتدائي بفسخ العقود وتأييده بحكم الاستئناف ولكن تم نقض ورفض الدعوى كاملة في محكمة التمييز. لم يتبقَ خيار سوى استلام الوحدات من المطوِّر. بمراجعة مساحة الوحدات في عقود البيع سنة 2006 وبالمقارنة مع التسجيل المبدئي وجدت أن المساحة نقصت بمعدل 15% عن المساحات التي اشتريتها وسددت مبالغ شرائها. السؤال الأن: كيف يمكنني المطالبة بتلك المساحات أو فسخ العقود واسترجاع المبالغ لعيوب في مساحات الوحدات؟

س: السلام عليكم، اشتريت رخصة كوفي شوب من مالك الرخصة القديم وحررت عقد إيجار مع مالك العقار لمدة سنة في شهر ١١/٢٠٢٠. بسبب الكورونا والانشغال لم افتتحها والشيكات مع مالك العقار والحين يطالبني بمبلغ فوق مبلغ الشيكات وأيضًا بمبالغ مستحقة على مالك الرخصة القديم وأيضًا مبالغ إضافية من فترة انتهاء عقد الإيجار ولتاريخ اليوم. مع العلم أن المالك لم يقم يودع الشيكات في البنك ولم يحصل على شيك مرتجع وانقضى على تاريخ استحقاقها سبعة أشهر. هل يمكنه إيداع الشيكات أو فتح قضية ضدي؟ وشكرًا!
