Q: Hi, My father has a few court cases due to bounced cheques in 2005. He left the UAE before the cheques bounced, which were worth approximately AED 42,000, AED 954,000, and AED 138,000. His brother was managing the business, which caused cash flow problems, resulting in the cheques bouncing in Abu Dhabi. Before this incident, he had lived in the UAE for more than 30 years without any problems. I want to find out if it is possible to clear these cases and, if so, what would be the expected cost.

Q: I’m seeking a lawyer for a case of wrongful deportation in contravention of the UAE Constitution “Part Three: Freedom, Rights and Public Duties” Articles 25, 26, 27 & 28. The victim was a Dubai resident with Emirates ID & 2 years to expiry. One afternoon 3 police officers not in uniform broke down the front door of their apartment without proof of ID. Once inside, the officers ransacked the apartment without explanation. The 2 residents showed legal papers including Emirates ID, work permits, and apartment rental. Nothing was found & the resident was asked to accompany the officers to a bus with other females. At CID headquarters the victim was not given any explanation, was refused a lawyer & tried to contact their embassy. Under duress, they were taken to a private room, photos & eye scans were taken then forced to sign papers in Arabic without any translation. The victim was held for 2 weeks and then deported without explanation. How can they challenge this case & return to Dubai?

Late fees and plot area discrepancy. What to do?

Q: Good evening, I purchased my off-plan property in 2017 and paid only 5% of the total value. After 6 months, I informed the developer via email that I no longer wish to continue with the purchase. However, on 16/2/2023, I received a notification from the Dubai Land Department stating that I must settle my outstanding payments within one month. My question to you is whether I am eligible to pay any late penalty fees, considering that the developer failed to complete the project on time. Additionally, on my SPA, the plot area was stated as 3509 sq. ft, but upon measuring it, I found that it was actually less than 2400 sq. ft. At the time of purchase, they charged an extra 200,000 AED, and are now counting late payment penalties at a rate of 1.5% per month. Given these circumstances, what should I do? Can you guide me? رفعت زوجتي علي دعوى نفقة في الإمارات وأنا في فلسطين. ماذا أفعل؟

س: السلام عليكم، أنا أقطن الآن في بلدي فلسطين ورفعت زوجتي علي دعوى نفقة بمبالغ تقدر شهريًا ما يقارب 24 ألف درهم مع أن دخلي الشهري 8000 درهم و لدي تمويل شخصي وسيارة شهريًا يخصم 4000. كانت هناك الجلسة الأولى عبر الأونلاين وحكم القاضي بتأجيل الجلسة للصلح بعد حوالي أسبوع من الآن، خلال الجلسة شرحت للقاضي عن أسباب الخلاف حيث أن أخت زوجتي وأخوها ووالدها كانوا يقنطون عندي في نفس المنزل وطلبت منها بأن يذهبوا إلى إخوانها للعيش هناك في الإمارات نفسها. فحدث شجار وجلبت لي الشرطة وطردتني من المنزل علمًا بأن المنزل باسمها. سافرت لوحدي إلى فلسطين ورفعت عليها في بلدي دعوى طاعة ودعوى ضم أولاد حيث حسب القانون الفلسطيني يحق لي حضانتهم. الآن ليس لدي المقدرة المالية على توكيل محامي في الإمارات وحضور الجلسة القادمة للجواب على الدعوى. ماذا بمقدوري أن أصنع في هذه الحالة؟
