Q: Topic: Pay-out of Notice Period (UAE) Employer`s Question: An employee (who has resigned) does not wish to work his notice period, and the company agrees with this as they see no reason for the employee to work. Tenant refuses to vacate despite registered email notice

Q: Dear Sir/Madam, I gave a 12-month notice to vacate to my tenant, using the registered email service from Emirates Post. Now, two weeks before the eviction date, my tenant refuses to leave the apartment claiming the notice was not given rightfully and that the notice letter must be stamped by Dubai courts and be delivered in English and Arabic, and that the registered email is not recognizable by law. As far as I understand it is an either/or question: either you send the vacation notice through the Dubai courts or you send it privately through registered mail, where it is not necessary for the notice to be stamped and attested by the court. According to Emirates Post, the registered email is fully recognized by law. Advice on this matter is very much appreciated. Thank you!

What can I do if a company hired me then changed their mind?

Q: I am working in a company and their management is the worst. They made an interview in India and called me. After calling me here, they again made interviews and made me work for 1 month. And now, they`re telling me I am not capable of work and they are mentally torturing me. I have given them 1.5 lack in office in India and here they are not paying me any salary. Can I cancel car purchase and get refund after the car failed RTA inspection?

Q: Hi. I paid an advance of AED 5000 to purchase a car. The next day we met at RTA but the car failed the inspection test. The seller also (verbally) committed to me to provide full-service history which he did not bring. I now have too much doubt so I want to cancel the deal, but the seller is refusing to refund my money and saying he can have the identified problem fixed. I do not trust him anymore. Can I get a refund? I have his sms message confirming the advance payment.

New owner in Dubai with no Ejari and previous tenant: What are his rights?

Q: Dear Sir/Madam, I recently purchased a studio flat in Dubai that was previously tenanted under a Tenancy Contract from November 2022 to November 2023. However, there is no registered Ejari to establish a tenant-landlord relationship in the Dubai Government record. The previous landlord had given the tenant a year`s notice to vacate the flat, which was given six months ago. Now that I have purchased the flat, I have asked the tenant to replace the cheques, but she has refused to cooperate. Can you please advise me on whether I am obligated to continue the Tenancy Agreement signed by the previous owner, given the absence of an Ejari? Alternatively, when can I tell her to vacate the flat, or do I have to wait until November 2023? Secondly, I would like to know if I need to serve the tenant with an eviction notice again to vacate the flat. If so, for how long is the remaining period valid, or do I need to issue a new eviction notice of one year? I would appreciate your prompt response. Many thanks! Kind Regards,

Supervisor took my photo without consent: Can I sue?

Q: Dear Sir/Madam, During my work, I am supposed to wear safety glasses, but unfortunately, due to some reason, I removed them. At that time, my supervisor took a picture of me with my face more visible and shared the photo in an email to safety personnel and other team members. He took the photo without my consent. Is it fair to reduce gratuity in employee contract amendments?

Q: Dear Sir/Madam, I have worked continuously for a company for 10 years and am now being retired. My original contract was signed in 2013. However, in 2018, we were asked to sign a new contract and were given a gratuity payment. On 1 January 2023, we were given another new contract which further reduced the gratuity. Each new contract has reduced the gratuity from the original contract. I understand that contract amendments should not disadvantage employees. Therefore, should the gratuity be paid at the original, most beneficial rate for the employee?

Is the eviction notice still valid after changing ownership?

Q: Hello, I recently bought a property in Dubai with the intention of moving in. However, there is a current tenant who was served an eviction notice by the previous landlord. The eviction notice is set to expire on June 8, 2023. I have asked the tenant when they plan to move out, but they are refusing and claiming that the eviction notice is void because there has been a change in ownership. Unfair maintenance charges for vacated apartment - What to do?

Q:   Dear Sir/Madam,       We vacated our 1 BHK apartment after a year. Recently, we received an email from the management regarding maintenance charges of AED 5812. The details show pictures of almost everything in the house that are not damaged.       They have mentioned that they need to replace everything with new items, including the toilet paper handle, shower cap, shower head, valve, soap handle, and so on.       When we asked the management why they needed to replace these items, they simply responded by saying that Dubai properties are expensive and they are very strict.       However, they could not provide a reason as to why these items needed to be replaced when they were not damaged. They only said that new items are given to new tenants, and the same would happen to the next tenant as well.       We have disputed these charges, but the management responded by saying that they do not have a dispute team and we are required to pay the full amount.       We had requested them to inform us during the inspection, but they failed to notify us and conducted the inspection without our knowledge.
