Questions & Answers
Deported after being acquitted in a drug case. Can I apply to have the deportation lifted?
Hi,
I am an Indian and have been working in Dubai for the last 8 years. I had a criminal case (drug case).
I proved my innocence in court and was released from jail after 10 months, but the federal authority deported me from the country.
Can I remove my deportation?
Dear Questioner,
Thank you for reaching out and sharing the details of your situation!
Although you were acquitted in your drug-related case, the deportation issued by UAE federal authorities appears to be administrative in nature.
Under UAE law, there is a legal mechanism to apply for the lifting of such a deportation.
This process involves submitting a formal request to the General Directorate of Residency and Foreigners Affairs (GDRFA) or the Federal Authority for Identity and Citizenship, supported by documents such as the court judgment, police clearance certificates (from both the UAE and India), and evidence of a valid reason for return (such as employment or family ties).
Given the sensitivity of drug-related cases in the UAE, the procedure can be complex, but with the right documentation and legal representation, removal of the deportation is possible.
I strongly recommend scheduling a formal consultation so we can review your documents and begin preparing the application accordingly.
Best regards,
Dear Questioner,
Thank you for reaching out!
We understand your situation regarding the deportation order issued against you following the dismissal of the criminal case.
In the UAE, there are two types of deportation: legal (judicial) and administrative (by immigration or federal authorities).
Since your deportation was issued by the federal authority despite being acquitted by the court, it is considered an administrative deportation.
The good news is that administrative deportation can be appealed. Our legal team can assist you in filing a request to lift the deportation by submitting an application to the General Directorate of Residency and Foreigners Affairs (GDRFA), along with:
- A copy of the court judgment proving your acquittal,
- Your passport and visa documents,
- A legal justification for returning,
- A no-objection certificate (NOC) if required, and
- Power of attorney (if you want us to represent you).
Once the application is submitted, the GDRFA will review your case and may grant permission to re-enter the UAE.
We are an experienced legal team in the UAE and would be happy to assist you with this process. Please let us know if you'd like to proceed, and we will guide you step by step.
Kind regards,

Hello,
Thank you for reaching out and sharing your situation!
Yes, it is possible to apply for the removal of a deportation order in the UAE, even after a criminal case, especially if you have been proven innocent by the court.
You may submit a formal request to the Public Prosecution in the emirate where the deportation was issued, along with supporting documents such as your court judgment and any evidence proving your innocence.
The authorities will review your application and decide whether to lift the deportation order.
This process can be complex and requires careful preparation of documents and legal arguments. I offer professional legal services to assist you with:
- Preparing and submitting your application for deportation removal,
- Gathering and organizing all necessary supporting documents, and
- Liaising with UAE authorities and representing your interests throughout the process.
If you would like to proceed or need further guidance, please let me know. I am here to support you every step of the way.
Best regards,
Hello,
Thank you for reaching out!
In cases involving deportation by federal authorities, it is sometimes possible to challenge or request the removal of the deportation order, but this depends on the specific circumstances and legal grounds.
Since you were proven innocent by the court, there may be legal options to explore.
To assess your situation thoroughly and advise on the best course of action, we recommend booking a consultation or appointing our firm to assist you with the legal procedures.

Thank you for your message and for sharing the background of your situation!
Since your criminal case concluded in your favor and the court found you innocent, the deportation issued appears to be an administrative (federal) deportation, not judicial.
Such deportations can potentially be lifted through a formal legal application supported by strong justifications and relevant court documents.
The process involves filing a petition to lift the deportation before the competent authority, often through the Public Prosecution or the Ministry of Interior, depending on the circumstances of your case.
Given your long residency in the UAE and the court's finding of your innocence, you may have a strong basis to proceed.
I recommend we schedule a consultation to review your judgment papers and deportation order in detail, so I can advise you properly and begin the legal process to lift the ban.

Hello,
The removal of deportation (also called a deportation ban lift) is possible under UAE law, but it requires filing a formal request to the Public Prosecution or Federal Authority for Identity, Citizenship, Customs and Port Security (ICP).
You must appoint a local lawyer in the UAE to file a petition to lift the deportation and provide strong justifications, such as your proven innocence, clean prior record, long-term residency, and humanitarian or family reasons (if applicable).
