What are the chances of lifting an immigration ban drug case?

Good morning.

My wife is Philippino national and I am a UK national working in Dubai.

In March 2016, my wife was arrested and charged with the Abuse of Psychotropic Substances. She was sentenced to 1 year in jail.

After 6 months she was deported back to the Philippines (September 2016) and is now on the immigration blacklist, I have had this confirmed. At that time she was single, we met later.

I understand it is legally possible to get her name removed from the immigration blacklist, but my question is have the UAE courts ever lifted an immigration ban for someone jailed for a drug offense?

I understand the law is rarely ‘black and white’ but would appreciate a legal view.

Obviously, I would like my wife to join me here in Dubai and I’m just trying to understand if this is actually feasible or we should just accept that we will have to live apart while I work in the UAE.

Thank you for reaching out,

Lifting a drug case is very difficult and you will spend a lot of money on it. But you can submit or appoint a lawyer to submit a petition on her behalf.

If you have further queries regarding this matter, Please provide your contact number for us to assist you on Whatsapp.

Thank you for your honest reply, and whilst I don't mind spending money on this quest, it only makes sense if there is a reasonable chance of success.

I suspect that my chances of success are actually quite small, this is exactly what I was trying to understand.

We can submit a petition but we cannot assure the outcome because it depends on the committee and what will their decision be.

You can submit a request to the court and try your luck, especially since she is your wife and you need her to live with you.

Hi

First of all, I would like to know if the psychotropic substance found was for her own consumption?

Do you have a copy of the judgment and for how long she stayed in the UAE before she was blacklisted?

Did she ever file a mercy petition?

19 Apr 2022, 07:39

She did not have any in her possession, she tested positive after arrest.

She had worked in Dubai for I think about 8 or 9 years before the arrest.

She did not file a mercy petition, she could not afford a lawyer to work for her case at that time.

Well, in that case, we can check the judgment, and based on the judgment we can file a mercy petition for her.

Can you send the judgment, her visa copy, and passport copy to us by email?
