What can my wife do if the company marked her as single and denied her maternity coverage?

Hello,

My wife's company renewed their insurance and registered my wife as single, so the maternity benefits are not covered, even though we were already married before she joined the company.

She is now 35 weeks pregnant. What should we do?

Hello,

Your wife should contact the company's human resources or insurance department and explain the situation.

Explain that the information she provided upon registration is incorrect and must be corrected because the company provides health insurance that should cover maternity benefits.

1. Check the terms of the insurance contract:

It is recommended that you review the terms of the health insurance contract between the company and the insurance company to determine whether maternity is generally covered by the insurance plan and whether coverage can be modified or added from now on.

2. Requesting retroactive coverage:

In some cases, the insurance company may modify health coverage retroactively after the situation has been corrected, especially if the error resulted from providing incorrect information upon registration. Therefore, it is possible to submit a request to have maternity coverage decided retroactively.

Dear questioner,

File a complaint with MOHRE against the employer for the incorrect insurance. The chances of rectifying it and getting coverage are low, but you should still try.

If you need further clarification, kindly share your WhatsApp number.

Their HR told us that their new insurance is asking for a loading amount of AED 18,000 to cover my wife's maternity benefits. Their HR wants us to pay that AED 18,000 loading amount required by the insurance.

Under UAE law, companies are required to provide maternity benefits to female employees, and the health insurance should cover maternity, including childbirth expenses, if it is part of the employment contract.

If your wife was mistakenly registered as single, you can file a complaint against the company to have the situation corrected and ensure she receives the appropriate coverage.

Kindly contact us via phone or email for further assistance.

Dear Inquirer,

It is concerning that your wife’s maternity benefits are not covered despite being married prior to joining the company.

In the UAE, maternity benefits should be provided as per labor laws, especially for employees who meet the criteria for coverage. If your wife is being unfairly denied these benefits, there may be grounds for legal action.

We recommend scheduling a consultation with us to evaluate your case and discuss the best course of action, including potential claims for maternity benefits.

Book a consultation now through our website or contact us to arrange legal representation.
