Can an employee on sick leave legally apply for overtime work?

Hello Lawyers,

Eid Mubarak!

Could you please advise? Can an employee on sick leave also apply for overtime at the same time? Is there any law related to this?

Thank you!

Dear Client,

An employee on sick leave cannot simultaneously apply for overtime, as ill leave implies the employee is medically unfit to perform work duties.

UAE Labour Law requires employees on sick leave to provide a medical certificate confirming their inability to work. Overtime compensation is granted only for hours worked beyond regular working hours.

Best regards,

Dear questioner,

No, an employee on sick leave cannot simultaneously apply for overtime in the UAE. This is a fundamental contradiction.

Sick leave is granted to employees who are medically unfit to perform their work duties. It's intended to allow them time for rest and recovery.

Overtime implies that an employee is working beyond their regular working hours. It requires physical presence and the ability to perform work tasks.

You can ask for remuneration for the work you did during sick leave directly through your employer and negotiate over it. If you need further clarification, kindly share your WhatsApp number.

Greetings,

There is no law that allows an employee to claim overtime pay while on sick leave, as sick leave means no work is being performed during that period.
