ILO claim denied for submitting after 32 days. Do weekends count in the 30-day limit?

Hi,

My claim was rejected because I submitted it after 32 days instead of 30. I assumed that weekends wouldn’t count, so I submitted my claim immediately on the first working day.

Notably, the ILOE regulation does not clarify whether the 30 days refer to calendar or business days.

I explained this to them, but they keep rejecting my claim.

Hello,

Try submitting a request to them, as the requirements do not specify whether the 30 days are calendar days. Send them an email and try to convince them.

If possible, visit their center as well. If you need further clarification, feel free to ask.

Dear Inquirer,

Thank you for reaching out!

Your situation raises an important legal question regarding the interpretation of the 30-day deadline in the ILOE regulations.

If the law does not explicitly distinguish between calendar and working days, there may be grounds to challenge the rejection.

In your case, it is important that the application period complies with the legal requirements set forth in the regulations or rules related to filing claims.

If the regulations stipulate that the claim must be filed within 30 days of the event or due date, and there is confusion regarding the inclusion of weekends or non-working days, this may be a cause for confusion.

However, you must adhere to the regulations or guidelines issued by the relevant authority.

Even if you have a different interpretation of the calculation of days, if the specific regulations or rules require the claim to be filed within only 30 days, it may be difficult to convince the relevant authority to accept the claim after 32 days.

Dear questioner,

Most government authorities calculate calendar days; however, check with ILOE for any appeal possibility.

Dear Sir/Madam,

Thank you for bringing this matter to our attention regarding the rejection of your claim due to a submission delay. I understand your concern about the interpretation of the 30-day deadline and the inclusion of weekends in this calculation.

Given the complexity of your situation, I would recommend the following professional course of action:

1. Request Clarification:

Formally request a written clarification from the relevant authority regarding the exact interpretation of the 30 days, specifically addressing whether it includes weekends and holidays.

2. Appeal Process:

Inquire about the appeal process for rejected claims. Many administrative decisions have an appeals mechanism that you may be able to utilize.

3. Legal Consultation:

Consider seeking advice from a legal professional specializing in UAE labor law. They can provide a more detailed analysis of your specific case and advise on the best course of action.

4. Documentation:

Ensure all your communications and submissions are well-documented. This includes any evidence of your attempt to submit the claim on the first working day after the weekend.

5. Regulatory Review:

If possible, review the full text of the ILOE regulation to see if any clauses might support your interpretation of the deadline.

6. Formal Complaint:

If you believe the rejection is unjustified, consider filing a formal complaint with the Ministry of Human Resources and Emiratisation (MOHRE).

Remember, it's crucial to act promptly and maintain professional communication throughout this process. If you need any further assistance or clarification, please don't hesitate to ask.

Yours sincerely,

ABDUL WAHIED

Dear Questioner,

Thank you for providing the details of your case!

I understand your frustration with the rejection due to the 32-day submission, believing weekends would not count. Here’s a summary of key points:

1. 30 Calendar Days vs. 30 Business Days:

Unless the regulation explicitly states "business days," it is generally assumed that the 30-day deadline refers to calendar days, which includes weekends. This could explain the rejection of your claim.

2. Regulatory Ambiguity:

If the regulation doesn’t clarify whether weekends count, it’s worth requesting an official interpretation from the relevant authorities to avoid confusion.

3. Next Steps:

- Request Clarification: Consider formally asking the relevant body for clarification on the 30-day deadline.

- Appeal: If you believe the rejection was based on an incorrect interpretation, we can explore the possibility of an appeal or judicial review.

Please let me know how you would like to proceed, or if you need further assistance with the appeal process.

Best regards,

Mohammed Salah
