Can I reschedule my hearing or travel after paying my fine, despite the prosecution's appeal?

Hello,

I had a criminal case, and the judge issued me a fine of 3,702.

I paid the fine amount, but the prosecution appealed, and the hearing date is set for May 28, 2025.

Is there any possibility of advancing the date, or can I travel without facing any issues in the meantime?

Dear questioner,

The Public Prosecution’s appeal may affect the case status, and travel restrictions could be imposed until a final judgment is issued.

You can submit an official request to the competent court to request an earlier hearing date or apply for the temporary lifting of any potential travel ban until the appeal is resolved.

Contact us if you need assistance in resolving your issue in accordance with the proper legal procedures.

Dear questioner,

It is possible; however, there are a few more things to ensure. Since you have cleared the fines, you may need to obtain clearance and stop search papers for travel.

If you need our assistance in checking the ban and obtaining clearance papers, kindly share your WhatsApp number.

My dear,

If you wish to travel, you must submit a request to the prosecution to expedite the hearing date or authorize you to travel and return before the next hearing.

You can also submit a guarantor’s passport for this purpose.

A key concern is whether a travel ban has been placed on you. Even if you've paid the initial fine, the prosecution's appeal could impose the ban on you again.

It would be better to submit a request to the prosecution regarding the situation and obtain approval.

If you need further assistance, kindly share your WhatsApp number.

Since the Public Prosecution has appealed your case, it means the judgment is not yet final. Here’s what you need to consider:

- Preponing the Hearing Date:

You can submit a request to the court through your lawyer to expedite the hearing. However, approval depends on the court's discretion and the reason for urgency.

- Travel Restrictions:

Since the case is under appeal, there is a possibility of a travel ban. You should check with the court or police to confirm if any restrictions are in place. If there is a ban, you may need to file a request for travel permission.

- Legal Representation:

It is advisable to have a lawyer represent you in court to handle the appeal and check the possibility of early closure.

For assistance in checking travel restrictions, expediting the case, or legal representation, contact us.

If the prosecution appealed, it means there is no bail, and you are banned.

Dear Sir/Madam,

Regarding your inquiry about the criminal case appeal and travel considerations:

1. Appeal Status: The prosecution has appealed the decision, with the hearing scheduled for May 28, 2025.

2. Travel Restrictions: Despite the fine payment, a travel ban may remain in effect until the appeal process concludes. Such restrictions are standard practice in the UAE for both criminal and civil cases under appeal.

3. Hearing Date Modification: There is no standard procedure for expediting appeal hearing dates. Courts typically schedule based on their existing caseloads and internal processes.

4. Travel Risks: Attempting to depart the UAE before the appeal hearing may result in complications at border control. It is strongly advised to await the conclusion of the appeal process.

5. Status Verification: To confirm your current travel status, we recommend consulting your legal representative or the relevant court authorities directly.

Given the complexities of your situation, we strongly advise seeking counsel from us. We can provide personalized guidance on your rights, potential options for expediting the process, and the safest course of action regarding travel.

Sincerely,

Greetings,

If the Public Prosecution has appealed your case, the legal proceedings are still ongoing despite paying the fine.

Advancing the hearing date is generally difficult, but it may be possible under specific legal grounds. Regarding travel, restrictions may apply, depending on whether a travel ban has been imposed.

To assess your options and take necessary legal action, we recommend booking a consultation with us or appointing us to handle your case.

Let us know how we can assist you.

Thank you for reaching out!

Since the Public Prosecution has appealed your case, it means the matter is still under judicial review. Typically, court hearings follow a set schedule, but in certain cases, a request to expedite the hearing can be made under valid grounds.

Regarding your travel, it’s essential to check if any travel restrictions have been imposed due to the ongoing appeal.

I can assist you in verifying this and exploring options to either expedite the hearing or obtain necessary permissions for travel.

I recommend we discuss your case in detail to assess the best course of action. Please reach out to me via WhatsApp or phone to discuss further.

Best regards,

To address your situation regarding a criminal case, it is possible to request an earlier hearing date depending on court rules, the prosecution's position, and judicial discretion.

However, success relies on following proper procedures and obtaining the judge's approval.

Additionally, you may be able to travel before the hearing if there are no outstanding legal restrictions, though potential risks exist if pending issues complicate your case.
