Questions & Answers
How can I lift a travel ban and relocate abroad with joint custody of my children?
Hello,
I am a Hindu Indian woman who recently got divorced in Dubai, with joint custody of my 1-year-old twin boys. My husband (also Indian and Hindu) imposed a travel ban on me before the divorce case.
What are the ways to remove the travel ban? I need to return to my country, as my financial situation here is challenging (even with the maintenance).
Will I be able to take my children with me if I secure a job in Australia?
Hello,
If the ban is linked to the divorce proceedings, you can approach the court or the Family Court (since you have joint custody) and ask for the travel ban to be lifted.
Given that your divorce is finalized and custody has been granted, you may have grounds to appeal for the ban to be removed, especially if it is preventing you from moving for personal or financial reasons.
Since you have joint custody, both parents typically need to agree if the children are to be taken abroad.
You must ensure that your husband is in agreement or that you have the legal right to travel with your children.

According to UAE law, you can file a request with the court to remove the travel ban, especially if you have strong reasons such as financial hardship. The court will consider the child's best interests and your need to travel.
Regarding taking your children to Australia, if you have joint custody, you would need the consent of your ex-husband or a court order, as traveling with children outside the country may require the approval of both parents.

The request has to be submitted to the court with sufficient reasons to convince the judge. Regarding taking your children to Australia, you would need to obtain their passports and visas.
You would also need to ensure that you have the necessary legal documents, such as the court order granting you joint custody, to demonstrate your legal right to travel with your children. We will discuss the procedures in detail.

To remove the travel ban, seek your ex-husband's approval or apply online through Dubai Courts. Resolving pending legal issues may lift the ban automatically.
For relocation with children, you need your ex-husband's consent. Without his agreement, court intervention is necessary but challenging. Consult with us for specific legal advice.
Thanks & Regards.

Dubai has recently implemented changes to travel ban procedures for divorced parents with joint custody. These changes aim to simplify the process and facilitate easier travel for parents and children.
The physical custody of the children would be with the mother; however, you need to obtain the permission of the court for shifting to Australia with children.
