Child custody and application of travel ban

My ex-husband and I just received the final divorce judgement from the court. I was granted custodianship of my daughter along with both her Jordanian passport and Canadian passport (I am her sponsor).

If I wanted also to enforce a travel ban in the UAE, how much should this cost approximately? Or can I file it myself? Is it just an application request or an actual court procedure?

Dear Ma'am,

I hope you are doing well.

Further to your query, kindly be informed that as you are already having the passport of your daughter in your custody, therefore in our opinion there is no need to enforce travel ban.

You should also note here that by law, the guardian (in this case it's your ex-husband) cannot travel without obtaining the custodian's approval and vice-versa.

But if still you believe and have any justifiable grounds that you’re ex-husband can flee along with your daughter without obtaining your approval, you can obtain a travel ban in order to prevent his move.

The court may grant the travel ban on the basis of your best interests. You can file it on your own and can get our assistance in drafting a travel ban petition.

Our professional fee for drafting a travel ban petition shall be AED 1,500.

Furthermore, we suggest you visit our office in order to discuss the matter in detail with our family lawyers.

To this end, you can call us at 045547635 or you can email us at info@awsuwaidi-advocates.com for fixing a schedule for the meeting.

Kindly please be reminded to bring the judgment copy along with you.

Aws M. Younis
