Is it normal for a judge to suspend an arrest warrant against a tenant for visa renewal?

Dear Lawyers,

I got an arrest warrant issued for a tenant in Dubai after the eviction process.

However, he submitted an e-request to suspend the arrest warrant so he could renew his visa without any supporting documents or payment.

The judge accepted a one-month suspension. Is this normal?

Dear Questioner,

In the UAE, it is within the discretion of the judge to temporarily suspend an arrest warrant under certain circumstances.

The purpose is often to allow the individual to address urgent matters, such as visa renewal or personal obligations.

However, such decisions are usually made on the basis of reasonability and do not negate the underlying legal obligations, including outstanding payments or compliance with a court order.

While the suspension is not unusual, it is essential to monitor the situation closely. If the tenant fails to fulfill their obligations within the granted period, you can file an objection or request the immediate reactivation of the warrant.

Ensure you document all communications and proceedings for reference.

For further legal guidance or assistance with filing objections, please contact us via phone, WhatsApp, or email.

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

The judge's acceptance of a one-month suspension for an arrest warrant without supporting documents or payment is unusual in Dubai's legal system, though judges do have some discretion in handling eviction and tenant cases.

This decision might be based on humanitarian grounds or to allow the tenant time to resolve visa issues, but it's not a standard practice.

If you feel the decision is unjust, consider consulting with us to understand your options for appeal or further action.

Yes, the judge may suspend an arrest warrant for a specified period in certain cases, especially if the tenant needs time to resolve their legal status, such as renewing their visa.

This is usually done following the proper legal procedures.

Dear questioner,

Yes, for the renewal of a visa, the tenant can request a one-month suspension. This suspension is allowed only for visa renewal purposes and not for traveling outside the UAE.

It is at the discretion of the judge to grant approval with or without a guarantee amount.

There are certain procedures with the court to file exceptions, allowing them to obtain permission to process the visa.

It can happen, and recently it has become possible to remove the arrest warrant in the Emirate of Dubai.
