Eviction of a tenant for defaulting on rent payment
Hello,
I'm an owner of an apartment in Dubai and my tenant is not paying rent.
I have submitted the legal notice with the notary public and it's already due, until now, the tenant is saying that he will pay.
I have one problem, the tenant is a male and I think he is out of the country, but all negotiations are with his wife and the cheque is given by his company.
How can I evict them from my property?
Please help.

Thank you for getting in touch with me on this query.
For eviction, the landlord must issue a legal notice demanding the rent within 30 days.
Since you have done this, you may proceed to file a case before the Rent Dispute Committee (tribunal especially for disputes between landlord and tenant).
The said tribunal will issue an award for eviction.
You may raise your issue that the actual tenant is not in the country and the cheques are being issued by a third party.

I believe the answer of my colleague Hari Wadhwana is a great and complete one.
Additionally, I would like to shed the light to an important fact, which is that the eviction process is quite lengthily and you should start immediately because if it is true that the tenant is out of the country and you would require access to it, it must happen through the police department.
And for this, you would need a public prosecutor or court order to force-enter the unit. You should start now otherwise you will be losing a lot of rent value.
