Right of the bank to hold EOSB against credit card debts
Q: I got my EOSB but my bank holds the amount due to credit card outstanding. How will I arrange this one if I already left the UAE for good? Thank you

Taking action against a bank for freezing the EOSB without consent
Q: Good morning, I work for the MOE. I changed the emirate and they paid out my End of Service Benefit. My salary is still the same and I am still employed by the MOE. My bank put a freeze on my EOSB and subsequently used it to pay down my loan and credit card. Their reason was that my debt ratio was too high. I did not give them permission to do that but they did it anyway. I have never been late in paying them and I have been a customer since 2016. My question is, can the bank legally do that? Do I have to file a case against them? Also, how to stop the bank from taking my entire salary to pay down their debt if they can take my EOSB even though I am still working with the same company; with the same salary being deposited into the bank? Please advise!

How to settle a salary transfer loan in court?
Q: I have just lost a job with three months of garden leave till 30th June 2021. The salary transfer loan amounts to AED 600,000 outstanding. There is of course a signed blank cheque given to the bank. What options do I have to settle the loan with the bank? My preference would be to go to court and fight against the bank to settle.

Can the bank hold my EOSB and last salary against my credit cards and loan?
Q: I changed my job and received my EOSB from my previous employer, however, my bank is holding this amount. Unfortunately, my previous employer didn’t separate my final salary and gratuity as the details on my transaction state EOSB. I found out that this shouldn't be the case and understood that the Employer is responsible to separate this. Is there a way I can get the salary amount to my disposal and the bank keeps the rest against my outstanding credit cards & loan? Please note that I have not missed any payments against my outstanding I have provided the bank with my new visa, salary certificate, Emirates ID as requested. Still, I have been told they will not release my EOSB. I have already received a new employment salary on the same account. I would be grateful for your advice.

Can the bank freeze my end-of-service benefits even if I did not miss any payment?
Q: Hi, I am out of my job. My end-of-service money got blocked since I still have a personal loan for 2 more years. I plan to find another job and I am not leaving the UAE. Also, my husband is working here for many years. How can I release my end-of-service money?

Can the bank hold my EOSB after submitting all the documents for the new job?
Q: Hello, My EOSB from my previous employer was credited and kept on hold by my bank, though my new employment documents were updated within the timeframe. Still, the gratuity amount was adjusted to the loan without my consent. Is it legal to do so? In addition to the above, instead of adjusting the amount from my gratuity, they deducted it from my available funds which I have access to without informing me. R.

هل يحق للبنك حجز كامل الراتب بسبب تنفيذ شيك من دون رصيد؟
س: السلام عليكم، صدر قرار من المحكمة بسبب تنفيذ شيك من دون رصيد بمبلغ 24 ألف درهم. حجز البنك الذي أستلم منه الراتب الحساب والأموال الموجودة فيه. هل يحق للبنك حجز كامل الراتب المستلَم؟ مع العلم أنه يجب ربع الراتب فقط، ولكنه حجز الراتب بأكمله. ماذا أفعل في هذه الحالة؟

Can a new bank account be linked to debts from another bank tied to a salary account?
Q: Dear Lawyers, I have a travel ban and need to pay a 35k amount to the bank. Recently, the bank linked this amount to my salary account, showing a negative balance in my current account. Kindly advise if I open a new bank account, can the other bank link it for my due amount? Can I change my visa during the travel ban?

Filing a case for wrongfully encashing a guarantee cheque
3 years back I had given a post-dated cheque as a guarantee to a person whom I had to pay the money. In 3 years time before the due date of the post-dated cheque, I had paid him partially by cash and cheque for which I have his signed vouchers and the PDC cheque details. He was supposed to return back my PDC on the due date and collect the balance amount that was around AED 4000. The cheque value was AED 115,000. On the due date, he demanded more money from me and when I refused, he bounced the cheque and filed a cheque bounce case. He said I gave him a cheque of a closed bank account when he asked the money back and claimed the full amount. I was arrested and had to pay the fine for the cheque bounce case. With the agreement I have with me and the payment voucher proof, can I sue him back for the false accusation? And can I claim compensation for spoiling my name and image?
