Can I call clients more than twice a week with their consent under Telemarketing Regulations?

Hi all,

I need some clarification regarding Cabinet Resolution No. (56) of 2024 concerning the Telemarketing Regulations. I collect the contacts of potential clients in Dubai on my website.

By submitting their contacts, the client agrees to the processing of personal data.

Do I have the right to call such a client more than 2 times a week, especially if the consent indicates that the client agrees to be called more frequently than established by the Cabinet Resolution?

Greetings,

As long as the customer agrees to contact him, there is no problem.

Cabinet Resolution No. (56) of 2024 is a UAE law that regulates telemarketing activities. It aims to protect consumers from unwanted marketing calls and ensure that companies comply with specific marketing channels and times.

Here are some key points from the resolution:

- Unified national registry:

A registry will be supervised by the Telecommunications Regulatory Authority (TDRA) to protect consumers from unsolicited marketing calls.

- Marketing channels and times:

Companies must adhere to specific marketing channels and times for products or services provided by or through them.

- Administrative penalties:

The competent authority may impose penalties on companies that violate the provisions of the resolution.

How to respect Cabinet Resolution No. (56) of 2024:

- Do not make unsolicited marketing calls:

If you are a company, ensure your employees do not make unsolicited marketing calls to consumers.

- Register with the TDRA:

If you are a company engaged in telemarketing, register with the TDRA.

- Comply with marketing channels and times:

Adhere to the specified marketing channels and times for your marketing activities.

- Respect consumers' wishes:

If a consumer requests to be removed from your marketing list, comply with their request.

By respecting this resolution, you can contribute to a more regulated and consumer-friendly telemarketing environment in the UAE.

We are honored to provide you with legal support.

Dear Questioner,

According to the Cabinet Resolution No. (56) of 2024, telemarketing activities in the UAE are regulated and require prior consent from the individual before contacting them.

This means that you can only call a potential client if they have given their explicit consent to be contacted.

Thank you for your answer. They agree to be contacted by virtue of consent, I'm curious whether it is possible to call them more often than 2 times per week or not?

Dear Questioner,

Thank you for your question regarding the Cabinet Resolution No. (56) of 2024 concerning Telemarketing Regulations.

While obtaining the client's consent to process their personal data is crucial, the Cabinet Resolution has set strict guidelines regarding the frequency of telemarketing calls to protect consumer privacy.

Regardless of the consent you obtain from your clients, the legal limit of contacting a client more than twice a week remains in place, as it is a regulatory requirement.

Any deviation from this regulation could result in penalties or legal action, even with client consent.

I recommend reviewing your current consent forms and telemarketing practices to ensure they comply with the Resolution.

If you'd like, we can discuss how to structure your approach to maximize compliance while still reaching out to your potential clients effectively.

Feel free to reach out to me via WhatsApp or phone at [---------] to discuss further, or you can email me at [---------].

Best regards,

Suhail Rana
