Can my extended leave lead to rejecting my resignation?

Dear Lawyers,

I took 30 days of company leave, but because a family member got ill, I had to extend it by 15 more days.

My question is, if I decide to resign, can the company complain that since I took extra leave, they can reject my resignation?

No, they will not reject it, but they can deduct the extra days from your final settlement as per UAE law.

Dear Questioner,

You must notify the employer of your resignation, and then you must adhere to the legal notice period specified in your employment contract from one month to 3 months, or compensate the employer for that.

It is best to make a settlement with the employer regarding the additional days.

Dear inquirer,

As per UAE labor law, you are required to provide your employer with a notice period as specified in your employment contract.

The notice period generally ranges from 30 to 90 days, depending on your contract or company policy.

If you have taken additional leave beyond what was granted, this leave might be considered unpaid unless you have accrued leave days or have made arrangements with your employer.

The company generally cannot reject your resignation due to extended leave if you have met your notice period requirements and followed proper resignation procedures.
