Can we stay until the contract ends despite management change and rent increase?

Hello,

Our building management is changing, and we have a contract with them until November 15, 2024. We have paid up to that month.

On August 24, they messaged me on WhatsApp that they are changing management effective September 1, 2024. They only gave us a 7-day notice, which was not written but only communicated via WhatsApp.

The new management is now saying that they will increase the rent to 70K, while our current rent is only 46K. This massive increase is too high, and the notice is too short.

Do we have the right to stay in the property until our contract ends, even though the management is changing?

Hello,

Your rental contract is legally binding until its expiration date, provided that you have paid in advance. You have the right to stay in the property until the end of the contract on November 15, 2024.

The change in property management does not affect your rental contract. Here, you can file a complaint with the Rental Dispute Settlement Center or the relevant authority in your emirate.

For further assistance, kindly share your WhatsApp number.

Dear questioner,

Yes, you generally have the right to stay in the property until your contract expires on November 15, 2024, even if the building management changes, unless there is a clause in your tenancy agreement that allows unilateral changes for the management.

It would be best to discuss the matter in detail. Please share your phone number if you'd like to proceed.

Greetings,

They have no right to increase the rent without negotiation, agreement, and your explicit consent. The rent increase must be in accordance with the regulations.

Do not respond to this matter. You must respond to their notification with an explicit legal response. We are honored to provide you with legal support.

For further inquiries about your topic, you can visit our office or contact us via phone, WhatsApp, or email.

You have the right to stay in the property until November 2024, and you have the right to request the renewal of the lease for another year, from November 2024 to November 2025.

You have the right to stay in the property until November 15, 2024, despite the change in management, as long as you continue fulfilling your obligations under the existing lease agreement.

Dear Questioner,

Thank you for reaching out to me with your concern regarding the sudden change in building management and the proposed rent increase.

In Dubai, your tenancy contract is legally binding until its expiration date, regardless of any changes in property management.

The new management must honor the terms of your existing contract, including the rental amount, until it ends on November 15, 2024.

They cannot unilaterally increase the rent or force you to vacate the property before this date.

Additionally, any notice of rent increase must be provided with at least 90 days' notice before the renewal of the contract, and the increase must comply with the Rental Increase Calculator provided by the Dubai Land Department.

I recommend not accepting any changes or agreeing to any new terms without first consulting a lawyer to protect your rights.

If you'd like, I can assist you in addressing this issue formally with the new management and ensure your rights are upheld.

Please feel free to reach out to me directly via WhatsApp or phone at [--------] to discuss your situation further.

Best regards,

Suhail Rana
